Community Aggregate Payment Levy Regulation

The Community Aggregate Payment Levy Regulation enables municipalities to impose a community aggregate payment levy on a shipment of sand and gravel, based on a uniform levy rate of up to a maximum of $0.25 per tonne, at the pit from which the material was extracted. The levy charged helps municipalities offset the cost of repairs to infrastructure (mainly roads) that have been damaged by the heavy haulers coming from the sand and gravel extraction site.

Matters Relating to Assessment Complaints Regulation, 2018

The Matters Relating to Assessment Complaints Regulation, 2018 is a new regulation authorized by sections 484.1 and 527.1 of the Municipal Government Act, as amended. This regulation comes into force on January 1, 2018 and applies to all Alberta municipalities, except the border City of Lloydminster. The MRAC 2018 regulation is the primary regulation for the property assessment complaints system. It sets outs the rules and processes for assessed persons, assessment jurisdictions, assessment review boards (ARBs) and the Municipal Government Board (MGB) to follow, regarding filing, administering and hearings of property assessment and other tax complaints. This regulation also sets out training requirements for respective board members and rules around complaint filing fees and any application for and grant of costs.

Matters Relating to Assessment Sub-classes Regulation

The Matters Relating to Assessment Sub-Classes Regulation is a new regulation authorized by sections 322 and 370 of the Municipal Government Act, as amended. This regulation comes into force on January 1, 2018 and applies to all Alberta municipalities. It provides municipalities with flexibility in setting property tax rates by enabling councils to implement different tax rates for the non-residential class of property referenced in section 297(1)(b) of the Municipal Government Act. Municipal Gas Systems Core Market Regulation

This regulation defines the roles and responsibilities of natural gas consumers, municipal governments and natural gas marketers including gas co-operatives within a municipal setting. It establishes that an urban municipality that has operated a gas system continuously since December 31, 1994, may by bylaw forbid the right of local customers to obtain a gas supply contract from a direct seller, or to have gas delivered by a rural gas co-operative within part of an urban municipality. This protects a secure revenue source for municipal gas utilities.

Qualifications of Assessor Regulation

This regulation established the qualification criteria for individuals to hold the position of designated officer. Designated assessors working on behalf of municipalities must declare annually to the Minister of Municipal Affairs, their name, and qualifications to carry out duties as per the instruction in the Assessment Quality Minister’s Guidelines. The regulation outlines the following qualification criteria: holds the Accredited Municipal Assessor of Alberta (AMAA) or Certified Assessment Evaluator (CAE) issued by the International Association of Assessing Officers or Accredited Appraiser Canadian Institute (AACI) issued by the Appraisal Institute of Canada, or other qualifications and/or experience that are deemed equivalent by the Minister of Municipal Affairs.
