IN THE MATTER of a surface coal mine site of Coal Valley Resources Inc. in the Coal Valley Area.
WHEREAS Coal Valley Resources Inc. is the holder of Permit No. C 2005-6 authorizing the development of a surface coal mine site in the Coal Valley area;
WHEREAS the Energy Resources Conservation Board is prepared to grant Application No. 1564181 by Coal Valley Resources Inc., registered on March 6, 2008, to amend Permit No.
C 2005-6 for Mine No. 1778, subject to the terms and conditions herein contained; and
WHEREAS the Lieutenant Governor in Council, by Order in Council Number O.C. ###/2010 dated #, 2010, hereto attached as Appendix B, has approved the granting of this permit amendment.
The Energy Resources Conservation Board, pursuant to the Coal Conservation Act, being chapter C-17 of the Revised Statutes of Alberta, 2000, hereby orders as follows:
1) Permit No. C 2005-6 is amended.
2) Clause 2 is struck out and the following is substituted :
2) This Permit shall apply to some 18 650 Hectares, more or less, in Townships 46, 47, 48 and 49, Ranges 19, 20, 21, 22, and 23, West of the 5th Meridian, as shown on Appendix A of this approval.
3) Clause 18 is added as follows:
18) CVRI shall submit to the ERCB as part of its 2011 first quarter report an evaluation of opportunities to recover coal in the permit area, within Township 49 and Range 23 West of the 5th Meridian.
4) Appendix A is struck out and Appendix A attached hereto is substituted.
5) (1) Attached hereto as Appendix B, and made part of this permit, is the order of the Lieutenant Governor in Council authorizing the granting of this permit.
(2) This permit amendment is subject to the terms and conditions, if any, prescribed by the order of the Lieutenant Governor in Council set out in Appendix B.
