            The Lieutenant Governor in Council

            (a)        forms, a municipal district having the name “Lac La Biche County” by the amalgamation of the Town of Lac La Biche and Lakeland County,

            (b)        makes the Order in Schedule 1,

            (c)        establishes that Lac La Biche County is comprised of the land described in Schedule 2, and

            (d)        establishes the electoral wards for Lac La Biche County as described in Schedule 3,

            effective August 1, 2007.

SCHEDULE 1

SPECIAL PROVISIONS FOR THE FORMATION
 OF LAC LA BICHE COUNTY

Definitions

1        In this Schedule,

          (a)      “Minister” means the Minister of Municipal Affairs and Housing;

                 (b)     “New Municipal Authority” means Lac La Biche County formed by the amalgamation of the Town of Lac La Biche and Lakeland County;

                      (c)      “Old Municipal Authorities” means the Town of Lac La Biche and Lakeland County.

Transitional Provisions

2        All assets and liabilities, whether arising under a debenture or otherwise, rights, duties, functions and obligations of the Old Municipal Authorities are vested in the New Municipal Authority and may be dealt with in its name.

3        Subject to the Limitations of Actions Act, all rights of action and actions by or against either of the Old Municipal Authorities may be continued or maintained by or against the New Municipal Authority.

4        Bylaws and resolutions of each of the Old Municipal Authorities continue to apply within the boundaries of the Old Municipal Authorities until the bylaws and resolutions are repealed, amended or replaced by the council of the New Municipal Authority.

5        An agreement between either of the Old Municipal Authorities and a person or corporation that relates to the land described in Schedule 2 is binding on the New Municipal Authority.

6        A reference to either of the Old Municipal Authorities in any order, regulation, bylaw, resolution, certificate of title, agreement or other legal instrument is deemed to be a reference to the New Municipal Authority.

7        The employees of record of the Old Municipal Authorities who are available for work on August 1, 2007 are employees of the New Municipal Authority.

8          The Minister may decide any question arising over the division or apportionment of the property, rights, assets, and liabilities resulting from the formation of the New Municipal Authority.

Interim Council

9        The councils of the Town of Lac La Biche and Lakeland County are dissolved on the formation of the New Municipal Authority.

10      Until the organizational meeting resulting from the first general election, the interim council for the New Municipal Authority is comprised of the previous council members of each of the Old Municipal Authorities.

11      Until the organizational meeting resulting from the first general election, the Chief Elected Official for the New Municipal Authority shall be elected from within the interim council.

First General Election

12      Until changed by a bylaw of the New Municipal Authority,

                 (a)      the council of the New Municipal Authority consists of a Chief Elected Official and eight (8) other councillors,

          (b)     the Chief Elected Official shall be elected at large,

                 (c)      the New Municipal Authority is divided into seven (7) wards as described in Schedule 3,

                 (d)     wards 1, 2, 3, 4, 5, and 6 shall consist of the ward boundaries as described in Schedule 3 with one (1) councillor to be elected in each of ward, and

                 (e)      ward 7 shall consist of the boundaries as described in Schedule 3 with two (2) councillors to be elected in ward 7.

13      The first general election for the New Municipal Authority shall be held on October 15, 2007.

14      All councillors elected for a ward are to be nominated from and be resident in that ward.

15      The Returning Officer for the first general election shall be Lucien Cloutier, County Clerk of Lakeland County.

16      An organizational meeting is to be held no later than two (2) weeks after the date of the first general election for the New Municipal Authority.

Chief Administrative Officer

17      Until the new council otherwise directs, Duane Coleman, the Chief Administrative Officer of Lakeland County, is the Chief Administrative Officer of the New Municipal Authority.

18      The Minister may decide any questions arising from the organization and composition of the interim council.
