Ministerial Order (#012/2014)
(School Act)
    I, Jeff Johnson, Minister of Education, pursuant to Sections 228 to 232 inclusive 
of the School Act, make the Order in the attached Appendix, being an Order for the 
addition of the Bow Island Ward into The Holy Spirit Roman Catholic Separate 
Regional Division No. 4.

APPENDIX
An Order for the addition of the Bow Island Ward to 
The Holy Spirit Roman Catholic Separate Regional Division No. 4
WHEREAS Section 228 of the School Act permits a ward to withdraw from a 
regional division;
AND WHEREAS the electors of the Bow Island Ward of The Medicine Hat Catholic 
Separate Regional Division No. 20 voted in favor of withdrawing from its regional 
division and entering into negotiations with another regional division in accordance 
with Section 231 of the School Act, as a result of a plebiscite held during the general 
election of October 21, 2013;
AND WHEREAS the ward representatives of the Bow Island Ward elected pursuant 
to Section 229 of the School Act to represent the residents of the Bow Island Ward 
negotiated an agreement pursuant to Section 231(2) of the School Act with The 
Board of Trustees of Holy Spirit Roman Catholic Separate Regional Division No. 4, 
for the purpose of adding all the land in the Bow Island Ward to The Holy Spirit 
Roman Catholic Separate Regional Division No. 4;
AND WHEREAS The Board of Trustees of Holy Spirit Roman Catholic Separate 
Regional Division No. 4 passed resolution No. 6432/0414 that The Holy Spirit 
Roman Catholic Separate Regional Division No. 4 approve and accept the agreement 
entered into between the ward representatives of The Bow Island Roman Catholic 
Separate School District No. 82, a ward of The Medicine Hat Catholic Separate 
Regional Division No. 20, and The Board of Trustees of Holy Spirit Roman Catholic 
Separate Regional Division No. 4 dated April 16, 2014 in accordance with Section 
232(1) of the School Act;
AND WHEREAS The Board of Trustees of Holy Spirit Roman Catholic Separate 
Regional Division No. 4 and The Board of Trustees of Medicine Hat Catholic 
Separate Regional Division No. 20 have agreed to the division of assets and 
liabilities;
Interpretation
1.	In this Ministerial Order
a)	"Bow Island Ward" means the geographical area comprising the jurisdiction 
of The Bow Roman Catholic Separate School District No. 82 which is 
currently a ward of The Medicine Hat Catholic Separate Regional Division 
No. 20 established by Ministerial Order No. 086/94 dated August 9, 1994.
b)	"The Holy Spirit Roman Catholic Separate Regional Division No. 4" means 
The Holy Spirit Roman Catholic Separate Regional Division No. 4 
established by Ministerial Order No. 146/94 dated October 23, 1994.
c)	"The Expanded Holy Spirit Roman Catholic Separate Regional Division  
No. 4" or "The expanded regional division" means The Holy Spirit Roman 
Catholic Separate Regional Division No. 4 established by Ministerial Order 
No. 146/94 dated October 23, 1994 with the addition of the Bow Island 
Ward, pursuant to the terms of this Order.
d)	"Medicine Hat Catholic Separate Regional Division No. 20" means The 
Medicine Hat Catholic Separate Regional Division No. 20 established by 
Ministerial Order No. 086/94 dated August 9, 1994.
Expanded Holy Spirit Roman Catholic Separate Regional Division No. 4
1	Pursuant to Sections 228(2) and 232(1) of the School Act, all land included in 
the Bow Island Ward is taken from The Medicine Hat Catholic Separate 
Regional Division No. 20 and is added to The Holy Spirit Roman Catholic 
Separate Regional Division No. 4 as the regional division that is the recipient of 
the Bow Island Ward.
2	The name and number of the expanded regional division will continue to be The 
Holy Spirit Roman Catholic Separate Regional Division No. 4.
3	The members of the board of the expanded regional division shall continue to be 
a corporation under the name of The Board of Trustees of Holy Spirit Roman 
Catholic Separate Regional Division No. 4.
4	The members of the board of The Holy Spirit Roman Catholic Separate Regional 
Division No. 4 shall hold office until the first organizational meeting of the board 
held after the first general election held after the addition of the Bow Island Ward 
to The expanded regional division.
5	The Board of Trustees of The Expanded Holy Spirit Roman Catholic Separate 
Regional Division No. 4  shall be continue to be comprised of nine (9) trustees.
6	Pursuant to Section 262(1) of the School Act, The Expanded Holy Spirit Roman 
Catholic Separate Regional Division No. 4 shall continue to be comprised of five 
(5) wards as follows:
a)	Ward 1 (Coaldale, Broxburn, Fairview, Tempest and Area);
b)	Ward 2 (Lethbridge, Coalhurst, Craddock, Raymond, Stirling and Area);
c)	Ward 3 (Picture Butte, Diamond City, Iron Springs, Shaughnessy, Turin and 
Area);

12	The trustees as elected in the October 21, 2013 general election to The Holy 
Spirit Roman Catholic Separate Regional Division No. 4 shall remain as trustees 
of The Expanded Holy Spirit Roman Catholic Separate Regional Division No. 4 
as follows:

13	Whereas, the Bow Island Ward will no longer have ward status, the trustee 
position for the Bow Island Ward is eliminated.  The following trustee will cease 
to hold office effective September 1, 2014.

14	Pursuant to Section 232(1)(e) of the School Act, the assets and liabilities of The 
Medicine Hat Catholic Separate Regional Division No. 20 as at August 31, 2014 
attributable to the school operating in the Bow Island Ward shall be transferred 
to and become assets and liabilities of The Holy Spirit Roman Catholic Separate 
Regional Division No. 4, in accordance with the attached Schedule.  
15	In accordance with Section 232(2) of the School Act, this Order is effective 
September 1, 2014.
SCHEDULE
1	Capital Assets and Liabilities at the end of the day on August 31, 2014
The following account balances with respect to all the land, buildings, equipment 
and vehicles attributable to the school operating in the Bow Island Ward shall be 
transferred from The Medicine Hat Catholic Separate Regional Division No. 20 
to The expanded Holy Spirit Roman Catholic Separate Regional Division No. 4: 
a)	Original cost
b)	Accumulated amortization
c)	Supported debt
d)	Unexpended deferred capital revenue
e)	Expended deferred capital revenue
2	Operating Assets and Liabilities at the end of the day on August 31, 2014 
a)	The account balances with respect to the following operating assets and 
liabilities shall be transferred from The Medicine Hat Catholic Separate 
Regional Division No. 20 to The expanded Holy Spirit Roman Catholic 
Separate Regional Division No. 4:
i)	School Generated Funds (SGF) - SGF bank accounts and the 
associated liability attributable to the school operating in the Bow 
Island Ward.
ii)	Deferred Revenues - those attributable to the school operating in the 
Bow Island Ward including unexpended funds from the school based 
budget of the school operating in the Bow Island Ward.
iii)	School-based operating reserves - those attributable to the school 
operating in the Bow Island Ward based on the Audited Financial 
Statements of The Medicine Hat Catholic Separate Regional Division 
No. 20.
iv)	Unrestricted net assets and the non-school-based operating reserves - 
the amount to be transferred shall be the same proportion as that 
determined by calculating the percentage of eligible student enrolments 
as of September 30, 2013 attributable to the school operating in the 
Bow Island Ward (78 FTE students), to the total eligible student 
enrolments in The Medicine Hat Catholic Separate Regional Division 
No. 20 (2485 FTE students).  This prorated value will apply to the 
following net assests: 
The total of the unrestricted surplus and the total operating reserve 
detailed in The Medicine Hat Catholic Separate Regional Division  
No. 20 2013 Audited Financial Statements, Schedule of changes in 
accumulated surplus as of August 31, 2014 less the following:
a.	The total of school based reserves for the other schools 
outside the Bow Island Ward in Medicine Hat Catholic 
Separate Regional Division No. 20;
b.	The total of the School Generated Funds in the restricted 
revenue;
c.	Any amount in the unrestricted or restricted reserve received 
from the Government of Alberta or other sources associated 
with the modernization at Monsignor McCoy School; and,
d.	Restricted funds associated with the band program at 
Monsignor McCoy High School, Notre Dame School and St. 
Mary's School.
b)	Any credit enrolment unit adjustments affecting students in the Bow Island 
Ward school resolved after August 31, 2014 shall be assets or liabilities of 
The expanded Holy Spirit Roman Catholic Separate Regional Division  
No. 4.
