Income and Employment Supports Act
INCOME SUPPORT, TRAINING AND HEALTH BENEFITS 
AMENDMENT REGULATION

on March 22, 2012 pursuant to section 18 of the Income and Employment Supports 
Act. 
1   The Income Support, Training and Health Benefits 
Regulation (AR 122/2011) is amended by this Regulation.

2   Section 1(1)(v) is repealed and the following is 
substituted:


	(v)	"student funding" means a loan or grant, or both, obtained 
under the Student Financial Assistance Act or the Canada 
Student Financial Assistance Act (Canada), or a similar loan 
or grant, or both, as determined by the Director;

3   Section 19 is repealed and the following is substituted:
Student funding
19   A barriers to full employment household unit or an expected to 
work or working household unit is not eligible to receive income 
support and benefits if an adult member has been approved for 
student funding to attend full-time training.

4   Section 24(2)(a)(ii) is amended by striking out "benefit" 
and substituting "payment".

5   Section 56(1)(a) is amended by striking out 
"(AR 348/2003)" and substituting "(AR 186/2011)".

6   Sections 69, 70, 71 and 72 are amended by adding 
"member" after "part-time learner" wherever it occurs.

7   Section 92 is renumbered as section 92(1).

8   Section 94 is amended by striking out "delivered to the last 
known" and substituting "sent by ordinary mail to the".

9   Section 97(2) is amended by striking out "Exemption" and 
substituting "Exception".

10   Section 101(1)(b) is amended by striking out 
"(AR 384/2003)" and substituting "(AR 186/2011)".

11   Schedule 1 is amended in sections 1(1)(n) and 2(1)(o) 
by striking out "(s)" and substituting "(x)".

12   Schedule 2 is amended in section 1
	(a)	by repealing subsection (1)(o)(i) and substituting 
the following:
	(i)	a student loan that is not considered student funding as 
defined in section 1 of this Regulation, or
	(b)	in subsection (2) by striking out "received is" and 
substituting "received in".

13   Schedule 4 is amended by repealing  section 15(3) and 
substituting the following:
(3)  The amount that may be provided under this section includes, 
without limitation, the following:
	(a)	in areas where public transportation is available, the cost of a 
monthly transit pass;
	(b)	where the individual cannot reasonably be expected to use 
public transportation or there is no public transportation, an 
allowance on a per kilometre basis or the actual cost of a taxi;
	(c)	costs associated with operating a vehicle;
	(d)	costs associated with training and employment;
	(e)	costs of other goods and services that are essential for 
training and employment.

14   Schedule 5 is amended by repealing the Core Essential 
Payment Table and substituting the following:

Exceptions:
For each dependent child over the age of 12 in a barriers to full 
employment household unit or in an expected to work or 
working household unit, add $33.

15   In the following provisions "a student loan" is struck out 
wherever it occurs and "student funding" is substituted:
section 5(3)(c); 
section 6(3)(d); 
section 7(2)(c); 
section 19; 
section 51(6); 
section 63(b).

16(1)  In this section,
	(a)	"former Core Essential Payment Table" means the 
Core Essential Payment Table in Schedule 5 as it 
read immediately before the coming into force of 
this section;
	(b)	"new Core Essential Payment Table" means the 
Core Essential Payment Table in Schedule 5 as it 
reads immediately after the coming into force of 
this section.
(2)  Despite the repeal of the former Core Essential Payable 
Table pursuant to section 14, the former Core Essential 
Payable Table instead of the new Core Essential Payment 
Table continues to apply
	(a)	in the case of Expected to Work or Working 
household units and Barriers to Full Employment 
household units, until March 31, 2012, and
	(b)	in the case of Learners (Full-time): EI learner, 
non-EI learner and apprentice learner household 
units, until July 31, 2012.

2   Section 6(3) is amended by striking out "$1188" and 
substituting "$1588".

	(a)	in section 1(4)(a)(ii) by 
	(i)	striking out "$400" and substituting "$800";
	(ii)	striking out "$950" and substituting "$1150";
	(b)	in section 1(4)(b)(ii) by

4   This Regulation comes into force on April 1, 2012.

Alberta Regulation 72/2012
Fair Trading Act
ENERGY MARKETING AND RESIDENTIAL HEAT SUB-METERING 
AMENDMENT REGULATION

on March 22, 2012 pursuant to section 105(1)(c) of the Fair Trading Act. 
1   The Energy Marketing and Residential Heat 
Sub-metering Regulation (AR 246/2005) is amended by this 
Regulation.

2   Section 18(1) is amended by striking out "No" and 
substituting "Subject to section 18.1, no". 

3   The following is added after section 18: 
Security deposits
18.1(1)  A marketer may collect a security deposit from a consumer 
at the time the consumer enters into a marketing contract 
	(a)	if the consumer has no credit history,
	(b)	if, in the opinion of the marketer, the consumer has a poor 
credit rating, or
	(c)	if the consumer's previous supply of electricity or gas was 
cancelled for non-payment. 
(2)  The maximum amount of a security deposit that a marketer may 
collect from a consumer in respect of a contract for the supply of 
electricity is 30% of the consumer's yearly electricity bill, as 
estimated by the marketer. 
(3)  The maximum amount of a security deposit that a marketer may 
collect from a consumer in respect of a contract for the supply of gas 
is 30% of the consumer's yearly gas bill, as estimated by the 
marketer.
(4)  A marketer shall not accept a security deposit in cash from a 
consumer in a face to face transaction.
(5)  If a marketing contract is cancelled by a consumer pursuant to 
this Regulation, the marketer shall refund the entire security deposit 
to the consumer within 15 days of the cancellation irrespective of 
whether any energy was supplied under the marketing contract.   
(6)  Where a consumer has made all the required payments under a 
marketing contract for one year from the date the consumer enters 
into the contract, the marketer shall refund the entire security deposit 
to the consumer within 15 days from the date the last payment for 
that year was made.
(7)  This section applies where the consumer uses or consumes the 
energy supplied primarily for household purposes.
4   Section 22 is amended by adding "18.1(4), (5) or (6)," after 
"18,".

Alberta Regulation 73/2012
Traffic Safety Act
OPERATOR LICENSING AND VEHICLE CONTROL 
AMENDMENT REGULATION

on March 22, 2012 pursuant to section 64 of the Traffic Safety Act. 
1   The Operator Licensing and Vehicle Control Regulation 
(AR 320/2002) is amended by this Regulation.

2   Section 66.1 is amended
	(a)	in subsection (5) by striking out "An applicant for a" 
and substituting "A person who is applying for his or her 
first";
	(b)	by repealing subsection (6) and substituting the 
following:
(6)  A veterans' licence plate may be used only on the following 
motor vehicles:
	(a)	a motor vehicle with passenger class registration;
	(b)	a farm vehicle with Class 2 registration under section 
77;
	(c)	a motor cycle, except for an off-highway vehicle;
	(d)	a moped.
	(c)	by adding the following after subsection (6):
(6.1)  A person who is applying for his or her second or 
subsequent veterans' licence plate is not required to present the 
original approved application, but must present all other motor 
vehicle registration requirements to a Registry agent.
(6.2)  The Registrar shall waive the licence plate exchange fee 
for an application regarding a veterans' licence plate for a motor 
cycle or a moped if the application for the exchange is made to a 
Registry agent on or before April 30, 2013. 

3   This Regulation comes into force on April 12, 2012.
