APPENDIX C
ORDER
1	In this Order, "annexed land" means the land described in Appendix A and 
shown on the sketch in Appendix B.
2	For the purposes of taxation in 2011 and in each subsequent year up to and 
including 2025, the annexed land and the assessable improvements to it
(a)	must be assessed by the Town of Ponoka on the same basis as if they had 
remained in Ponoka County, and
(b)	must be taxed by the Town of Ponoka in respect of each assessment class 
that applies to the annexed land and the assessable improvements to it using 
the municipal property tax rate established by 
(i)	the Town of Ponoka, or 
(ii)	Ponoka County,
whichever is lower, for property of the same assessment class.
3	Where in any taxation year a portion of the annexed land
(a)	is redesignated at the request of or on behalf of the landowner under the 
Town of Ponoka Land Use Bylaw, or
(b)	is connected to water or sanitary sewer services provided by the Town of 
Ponoka
section 2 ceases to apply at the end of that taxation year in respect of that portion 
of the annexed land and the assessable improvements to it.
4	After section 2 ceases to apply to the annexed land or any portion of it in a 
taxation year, the annexed land or portion and the assessable improvements to it must 
be assessed and taxed for the purposes of property taxes in the following year in the 
same manner as other property of the same assessment class in the Town of Ponoka is 
assessed and taxed.

"Harmattan East Viking Unit No. 1"
    Whereas the Parties set forth and described in Exhibit "A" are Parties to the 
Agreement entitled "Harmattan East Viking Unit No. 1" effective the 1st day of 
October, 1986 and any subsequent amendments or revisions thereto (hereinafter 
referred to as the "said Agreement");
    And whereas the Parties have agreed to amend the said Agreement by amending 
the following definition:
101.(r) "Viking Formation" means the Upper and Middle Viking zones of the Lower 
Cretaceous Age which occurs between the Dual Induction-SFL Log depths of 2205.0 
and 2220.0m below the Kelly bushing in the well 00/06-13-32-03W5M located in 
section 13, township 32, range 3, west of the fifth (5) meridian, as set forth in Exhibit 
"C";
    	Now therefore in consideration of the premises and the mutual agreements herein 
contained, the Parties agree to and with each other as follows:
1.	Capitalized terms used herein shall bear the same meanings set forth in and in the 
said Agreement.
2.	This agreement is effective at 08:00 on the 1st day of the first calendar month 
following execution by all parties.
3.	Effective as of 08:00 on the 1st day the first calendar month following execution 
by all parties, Exhibit "C" to the said Agreement is amended and attached hereto 
and entitled Exhibit "C".
4.	Subject to the amendments specified above, the provisions of the said Agreement 
are hereby confirmed.
5.	This Amending Agreement may be executed in as many counterparts as may be 
necessary and, when a counterpart has been executed by each party hereto, all 
counterparts together shall constitute one (1) agreement.
