Health insurance Premiums Act
HEALTH INSURANCE PREMIUMS AMENDMENT REGULATION

on February 3, 2011 pursuant to sections 2 and 21 of the Health Insurance Premiums 
Act. 
1   The Health Insurance Premiums Regulation (AR 217/81) 
is amended by this Regulation.

2   The following provisions are amended by striking out 
"his" and substituting "his or her":
section 1(2)(f); 
section 3(1).

3   Section 7 is amended
	(a)	in subsection (2)
	(i)	by striking out "he" wherever it occurs and 
substituting "the registrant";
	(ii)	in clause (b) by striking out "him" and 
substituting "the registrant";
	(b)	by repealing subsection (4).

4   Section 8 is amended
	(a)	in subsection (3) by striking out "he" and 
substituting "he or she";
	(b)	in subsection (4)
	(i)	by striking out "his application" and substituting 
"his or her application";
	(ii)	by striking out "he may" and substituting "he or 
she may";
	(iii)	by striking out "his premium" and substituting 
"the registrant's premium".

5   Section 9 is amended
	(a)	in subsection (1) by striking out "he is unable to pay his 
premiums" and substituting "the registrant is unable to 
pay his or her premiums";
	(b)	in subsection (1.1) by striking out ", or" at the end of 
clause (a) and repealing clause (b);
	(c)	by repealing subsection (3.1) and substituting the 
following:
(3.1)  In making an application for waiver of premiums,
	(a)	an applicant shall disclose in the application the 
applicant's gross income received from all sources 
during the 3 calendar months immediately preceding the 
date of the application,
	(b)	an applicant with dependants shall include in the 
application the gross income received from all sources 
by the applicant's dependants during the 3 calendar 
months immediately preceding the date of the 
application, and
	(c)	an applicant who has rental income or income from 
self-employment, investment or a business, including a 
farming operation, shall disclose in the application the 
applicant's expenses in respect of the self-employment, 
investment, rental operation or business and the 
expenses shall be deducted from the applicant's gross 
income for the purposes of this section.
	(d)	in subsection (3.3) by striking out "his" and 
substituting "his or her";
	(e)	in subsection (3.5) by striking out "the Department of 
Family and Social Services" and substituting "the 
Department of Children and Youth Services, the Department 
of Employment and Immigration or the Department of 
Seniors and Community Supports";
	(f)	in subsection (3.6) by striking out "his" and 
substituting "his or her";
	(g)	in subsection (3.7)
	(i)	by striking out "he" and substituting "the 
applicant";
	(ii)	by striking out "his" and substituting "the 
applicant's".

6   Section 10 is amended
	(a)	by striking out "he" wherever it occurs and 
substituting "the registrant";
	(b)	in subsection (2) by striking out "his" and 
substituting "his or her".

7   Section 11(4) is amended
	(a)	by striking out "his" and substituting "his or her"; 
	(b)	by striking out "him" and substituting "the registrant";
	(c)	by striking out "he" and substituting "the registrant".

8   Section 12 is amended
	(a)	in clause (a)
	(i)	by striking out "he" and substituting "he or she";
	(ii)	in subclause (i) by striking out "social allowance 
under the Social Development Act, or" and 
substituting "income support or benefits under the 
Income and Employment Supports Act or";
	(b)	in clause (c) by striking out "his" wherever it occurs 
and substituting "his or her".

9   Section 13 is amended
	(a)	in subsection (2)
	(i)	in clause (d) by striking out "he" and 
substituting "he or she";
	(ii)	in clause (e) by striking out "his" and 
substituting "his or her"; 
	(b)	in subsection (4) by striking out "his" and 
substituting "the person's";
	(c)	in subsection (5) by striking out "form his group and 
his" and substituting "from the employer's group and to 
exclude the employee's".

10   The following provisions are amended by striking out 
"his" wherever it occurs and substituting "its":
section 14(1); 
section 15(3); 
section 16.

11   Section 19(2) is amended
	(a)	by striking out "his" and substituting "the registrant's";
	(b)	by striking out "he" and substituting "he or she".

12   Section 20(4) is amended
	(a)	by striking out "his" and substituting "its";
	(b)	by striking out "Minister's" and substituting "the 
Minister's".

13   Section 21 is amended
	(a)	in subsection (1) by striking out "himself and his" and 
substituting "himself or herself and his or her";
	(b)	in subsection (2)
	(i)	by striking out "he" wherever it occurs and

and substituting "a person registered as registrant under 
subsection (1)".

16   Section 24 is amended by striking out "himself while he" 
and substituting "himself or herself while he or she".

17   Section 25 is amended
	(a)	in subsection (1) by striking out "his" and 
substituting "his or her";
	(b)	in subsection (2) by striking out "reinstatment" and 
substituting "reinstatement";
	(c)	in subsection (3)
	(i)	by striking out "his registration" and substituting 
"his or her registration";
	(ii)	in clause (a) by striking out "he remains a resident 
of Alberta, his" and substituting "the person remains 
a resident of Alberta, his or her";
	(iii)	by repealing clause (b) and substituting the 
following:
	(b)	subject to section 8 of the Alberta Health Care 
Insurance Regulation (AR 76/2006), if the person 
leaves Alberta permanently, his or her entitlement 
to be registered or reinstated shall be in accordance 
with section 22 or 26. 

18   Section 26 is amended
	(a)	in subsection (1)
	(i)	by striking out "may register the resident and his 
dependants subject to section 30" and substituting 
"may, subject to section 30, register the resident and his 
or her dependants";
	(ii)	in clause (a)(i) by striking out "he" and 
substituting "he or she";
	(b)	in subsection (2) by striking out "his" wherever it 
occurs and substituting "his or her".

19   Section 27(1) is amended
	(a)	in clause (a) by striking out "social allowance under the 
Social Development Act or" and substituting "income 
support or benefits under the Income and Employment 
Supports Act or";
	(b)	in clause (b) by striking out "Minister of Family and 
Social Services" and substituting "Minister of Children 
and Youth Services, the Minister of Employment and 
Immigration and the Minister of Seniors and Community 
Supports";
	(c)	by striking out "he became entitled to an allowance under 
the Social Development Act or a benefit under the Assured 
Income for the Severely Handicapped Act, or the date on 
which he" and substituting "he or she became entitled to 
the income support or benefits,".

20   Section 28(2) is amended by striking out "his" and 
substituting "his or her".

21   Section 29 is amended by striking out "he" and 
substituting "he or she".

22   Section 30 is amended
	(a)	in subsection (1)
	(i)	by striking out "his dependants" and substituting 
"his or her dependants";
	(ii)	by striking out "his registration form" wherever it 
occurs and substituting "his or her registration 
form";
	(iii)	by striking out "he" and substituting "he or she";
	(iv)	in clause (a) by striking out "his" and 
substituting "the registrant's";
	(v)	by repealing clause (b) and substituting the 
following:
	(b)	the registrant's spouse or adult interdependent 
partner, if the registrant and his or her spouse or 
adult interdependent partner maintain separate 
homes, whether pursuant to a court order or 
separation agreement or not, or
	(b)	in subsection (3.1) by striking out "his" wherever it 
occurs and substituting "his or her";

substituting "section 8 of the Alberta Health Care Insurance 
Regulation (AR 76/2006)".

26   Section 33 is amended
	(a)	in subsection (1) by striking out "him have been made, 
then he shall be assumed no longer a resident of Alberta and 
his" and substituting "the registrant have been made, then 
the registrant shall be assumed to no longer be a resident of 
Alberta and his or her";
	(b)	in subsection (2)
	(i)	by striking out "he" wherever it occurs and 
substituting "the registrant";
	(ii)	by striking out "his" and substituting "the 
registrant's";
	(c)	in subsection (3) by striking out "he could not be 
located for any periods during which the registrant" and

HOSPITALIZATION BENEFITS AMENDMENT REGULATION

1   The Hospitalization Benefits Regulation (AR 244/90) is 
amended by this Regulation.

2   Section 20(1)(d) is amended by striking out "$2 500 000" 
and substituting "$5 000 000".
