Post-secondary Learning Act
PUBLIC POST-SECONDARY INSTITUTIONS' TUITION FEES 
AMENDMENT REGULATION

For information only:   Made by the Lieutenant Governor in Council (O.C. 448/2010) 
on December 2, 2010 pursuant to section 124 of the Post-secondary Learning Act. 
1   The Public Post-secondary Institutions' Tuition Fees 
Regulation (AR 273/2006) is amended by this Regulation.

2   Section 2 is amended
	(a)	by striking out "a public post-secondary institution other 
than Banff Centre" and substituting "an institution";
	(b)	in clause (a) by striking out "Approval of Programs of 
Study Regulation (AR 51/2004)" and substituting 
"Programs of Study Regulation (AR 91/2009)".

3   Section 5(1) is amended by striking out "Commencing" 
and substituting "Subject to section 5.1, commencing".

4   The following is added after section 5:
Market modification for tuition fees for specific  
programs
5.1(1)  In this section, "market modification" means a correction of 
a discrepancy between tuition fees set by a board of an institution in 
respect of a specific program of study and tuition fees for similar 
programs of study in other jurisdictions or in other sectors or 
institutions in Campus Alberta.
(2)  In addition to any increase in average tuition fees in accordance 
with section 5(2), a board of an institution may request in writing in 
a form and at times determined by the Minister that the Minister 
approve an increase in tuition fees in respect of a specific program of 
study for the purpose of establishing a market modification in 
respect of that program of study.
(3)  For the purpose of achieving the market modification referred to 
in subsection (2), the Minister may by order
	(a)	approve an increase in tuition fees for that specified program 
of study in the amount and for the period of time that the 
Minister considers appropriate, 
	(b)	specify to which students the increase in tuition fees applies, 
and
	(c)	specify any other terms and conditions applicable to the 
increase in tuition fees that the Minister considers 
appropriate.
(4)  The increase in tuition fees approved by the Minister under 
subsection (3) takes effect on the date specified by the Minister.
(5)  Where the increase in tuition fees approved by the Minister 
under subsection (3) has expired, all subsequent tuition fee increases 
for that specified program of study must be calculated in accordance 
with section 5.

Commencement
7(1)  Subject to subsection (2), this Regulation is deemed to 
have come into force on January 1, 2010.
(2)  Sections 3 and 6 come into force on January 1, 2011.

Alberta Regulation 216/2010
Oil and Gas Conservation Act
OIL AND GAS CONSERVATION AMENDMENT REGULATION

For information only:   Made by the Energy Resources Conservation Board on 
December 2, 2010 pursuant to section 10(1)(u) and (v) of the Oil and Gas 
Conservation Act. 
1   The Oil and Gas Conservation Regulations (AR 151/71) 
are amended by this Regulation.

2   Section 6.080 is amended
	(a)	by repealing subsection (2) and substituting the 
following:
(2)  The licensee shall set surface casing and meet 
requirements as prescribed in the Board's Directive 008, 
Surface Casing Depth Requirements, as amended from time 
to time.
	(b)	by repealing subsection (3);
	(c)	by repealing subsection (4)(b) and substituting the 
following:
	(b)	the Base of Groundwater Protection (BGWP) depth,
	(d)		by repealing subsection (6) and substituting the 
following:
(6)  The licensee shall ensure that surface casing is cemented 
full length before drilling more than 10 metres beyond the 
casing setting depth.

1   The Nursing Homes Operation Regulation (AR 258/85) is 
amended by this Regulation.

2   Section 3(1) is amended
	(a)	in clause (a) by striking out "$44.50" and 
substituting "$45.85";
	(b)	in clause (b) by striking out "$47.00" and 
substituting "$48.40"; 
	(c)	in clause (c) by striking out "$54.25" and 
substituting "$55.90".

3   This Regulation comes into force on February 1, 2011.

1   The Oil Sands Conservation Regulation (AR 76/88) is 
amended by this Regulation.

by the Board for those applications" and substituting "in the 
directives published by the Board regarding those applications".

Architects Act
ARCHITECTS ACT GENERAL AMENDMENT REGULATION

December 10, 2010 pursuant to section 9 of the Architects Act.
1   The Architects Act General Regulation (AR 200/2009) is 
amended by this Regulation.

2   Sections 6(2)(a)(ii) and 7(2)(a)(ii) are amended by striking 
out "3 years" and substituting "2 years".

3   The heading to Part 7 is amended by adding ", Expiry" 
after "Repeals".

4   The following is added after section 64:
Expiry
64.1   For the purpose of ensuring that this Regulation is reviewed 
for ongoing relevancy and necessity, with the option that it may be 
repassed in its present or an amended form following a review, this 
Regulation expires on October 31, 2018.

Municipal Government Act
WELL DRILLING EQUIPMENT TAX RATE REGULATION

on December 8, 2010 pursuant to section 390 of the Municipal Government Act. 
Calculation of tax for 2011
1   The tax under Division 6 of Part 10 of the Municipal Government 
Act must be calculated in 2011 as follows:
	(a)	if the depth of the well is 900 metres or less, $0.44 per metre 
of depth, with the minimum tax being $290;
	(b)	if the depth of the well is more than 900 metres but not more 
than 1500 metres, $435 plus $0.87 for each metre of depth 
exceeding 900;
	(c)	if the depth of the well is more than 1500 metres but not 
more than 1800 metres, $957 plus $1.02 for each metre of 
depth exceeding 1500;
	(d)	if the depth of the well is more than 1800 metres but not 
more than 2400 metres, $1450 plus $2.18 for each metre of 
depth exceeding 1800;
	(e)	if the depth of the well is more than 2400 metres but not 
more than 3000 metres, $2900 plus $5.22 for each metre of 
depth exceeding 2400;
	(f)	if the depth of the well is more than 3000 metres but not 
more than 3600 metres, $6382 plus $8.27 for each metre of 
depth exceeding 3000;
	(g)	if the depth of the well is more than 3600 metres but not 
more than 4200 metres, $11 893 plus $17.40 for each metre 
of depth exceeding 3600;
	(h)	if the depth of the well is more than 4200 metres but not 
more than 4800 metres, $23 496 plus $21.76 for each metre 
of depth exceeding 4200;
	(i)	if the depth of the well is more than 4800 metres, $38 000 
plus $26.11 for each metre of depth exceeding 4800.
Repeal
2   The Well Drilling Equipment Tax Rate Regulation (AR 263/2007) 
is repealed.
Expiry
3   For the purpose of ensuring that this Regulation is reviewed for 
ongoing relevancy and necessity, with the option that it may be 
repassed in its present or an amended form following a review, this 
Regulation expires on December 31, 2011.
Coming into force
4   This Regulation comes into force on January 1, 2011.
