Definitions
1   In this Regulation,
	(a)	"accounting standards" means the generally accepted 
accounting principles for municipal governments 
recommended from time to time by the Canadian Institute of 
Chartered Accountants, including any recommendations of 
the Public Sector Accounting Board;
	(b)	"Act" means the Municipal Government Act;
	(c)	"amortization" and "tangible capital assets" have the same 
meaning as in the Public Sector Accounting Handbook, 
published by the Canadian Institute of Chartered 
Accountants, as amended from time to time;
	(d)	"annual budget" means a combined operating budget and 
capital budget for the calendar year determined on a basis 
consistent with accounting standards and the requirements of 
Part 8 of the Act.
Annual budget
2(1)  For the 2009 and subsequent calendar years, a municipality may 
adopt an annual budget in a format that is consistent with its financial 
statements.
(2)  For the purposes of sections 247 and 248 of the Act, the adoption 
of an annual budget is equivalent to the adoption of an operating 
budget under section 242 of the Act and a capital budget under section 
245 of the Act.
Total expenditures
3   For the purposes of sections 243(3) and 244(1) of the Act, the total 
expenditures referred to in those sections do not include any 
amortization on tangible capital assets, unless the amortization
	(a)	is an amount required to provide for amortization of the 
tangible capital assets of a municipality's municipal public 
utilities as defined in section 28 of the Act, and
	(b)	relates to at least one year of the 3-year period referred to in 
section 244(1) of the Act.
Accumulated surplus
4(1)  For the 2009 and subsequent calendar years, the accumulated 
surplus net of equity in tangible capital assets as shown on a 
municipality's audited annual financial statements must not be less 
than zero.
(2)  If for any given year a municipality has an accumulated surplus net 
of equity in tangible capital assets that is less than zero in 
contravention of subsection (1), the Minister may, if the Minister 
considers it necessary to do so, establish that municipality's annual 
budget for the next calendar year, and that annual budget
	(a)	is for all purposes the municipality's annual budget for that 
calendar year, and
	(b)	may not be amended or replaced by council.
Expiry
5   This Regulation is made in accordance with section 603(1) of the 
Act and is subject to repeal in accordance with section 603(2) of the 
Act.

NEWELL REGIONAL SERVICES CORPORATION REGULATION

Definitions
1   In this Regulation,
	(a)	"Act" means the Municipal Government Act;
	(b)		"public utility" means a system or works used to provide the 
following for public consumption, benefit, convenience or 
use:
	(i)	water;
	(ii)	sewage disposal.
Application of Act
2(1)  Subject to subsection (2), sections 43 to 47 of the Act apply in 
respect of a utility service provided by Newell Regional Services 
Corporation.
(2)  Section 45(3)(b) of the Act does not apply in respect of a public 
utility owned or operated by Newell Regional Services Corporation.
Exemption from Public Utilities Act
3   Part 2 of the Public Utilities Act does not apply in respect of a 
public utility that
	(a)	is owned or operated by Newell Regional Services 
Corporation, and
	(b)	provides a utility service within the boundaries of a 
municipality that is a shareholder of Newell Regional 
Services Corporation.
Dispute resolution
4   If there is a dispute between a regional services commission and 
Newell Regional Services Corporation with respect to
	(a)	rates, tolls or charges for a service that is a public utility,
	(b)	compensation for the acquisition by the commission of 
facilities used to provide a service that is a public utility, or
	(c)	the commission's use of any road, square, bridge, subway or 
watercourse to provide a service that is a public utility,
any party involved in the dispute may submit it to the Alberta Utilities 
Commission, and the Alberta Utilities Commission may issue an order 
on any terms and conditions that the Alberta Utilities Commission 
considers appropriate.
Provision of extra-provincial services
5   Newell Regional Services Corporation shall not provide any utility 
services outside of Alberta without the prior written approval of the 
Minister.
Expiry
6   This Regulation is made under section 603(1) of the Act and is 
subject to repeal under section 603(2) of the Act.

Coming into force 
8   This Regulation comes into force on the coming into force of 
section 14 of the Post-secondary Learning Amendment Act, 2008.

Alberta Health Care Insurance Act

the business of the Appeal Panel, and

Maintenance Enforcement Act
MAINTENANCE ENFORCEMENT AMENDMENT REGULATION

1   The Maintenance Enforcement Regulation (AR 2/86) is 
amended by this Regulation.

2   Section 1 is amended
	(a)	by adding the following before clause (c):
	(b.1)	"remuneration for employment" includes
	(i)	salary, wages, allowances, commissions, bonuses, 
incentives, holiday pay and vacation pay, and
	(ii)	income that, in the opinion of the Director,
	(A)	replaces remuneration from employment, and
	(B)	is appropriate in the circumstances to treat as 
remuneration from employment,
		but does not include termination or severance pay;
	(b)	by repealing clause (d).

3   Section 2(2) is amended by striking out "also" and 
substituting ", when required by the Director,".

4   Section 5(8)(a) is amended by striking out "a filed copy" 
and substituting "2 filed copies".

5   Section 11(d) is amended by striking out "exemption" and 
substituting "restriction".

6   Section 13 is repealed and the following is substituted:
Support deduction notice - restriction on remuneration 
from employment
13(1)  Subject to an order obtained under section 17(4) of the Act, 
a support deduction notice with respect to remuneration from 
employment may not require payment to the Director of more than 
40% of the gross amount of remuneration per month without the 
debtor's consent.
(2)  If the Director makes an application under section 17(4) of the 
Act, notice of the application must also be served on the creditor.

7   Section 15(1) is amended
	(a)	in clause (a) by striking out "wages or salary" and 
substituting "remuneration from employment";
	(b)	by repealing clause (b) and substituting the 
following:
	(b)	how the amount payable under the support deduction 
notice was calculated, and

8   Section 22(2) is amended by striking out "Form 8" and 
substituting "Form 6".

9   Section 24 is amended by striking out "subsection" 
wherever it occurs and substituting "section".

10   Form 1 in the Schedule is repealed and the following is 
substituted:

under the policies of the Maintenance Enforcement Program, the 
Director will adjust the amount of support payable as follows:
	a.	If one child is no longer eligible for support collection, then 
the base child support payment shall be reduced to

	b.	If         children are no longer eligible for support collection, 
then the base child support payment shall be reduced to

7.	Additional Expenses Relating to the Child(ren)

ASSESSMENT COMPLAINTS FEE REGULATION

Definition
1   In this Regulation, "Act" means the Municipal Government Act.
Maximum fees
2   For the purposes of section 481(1) of the Act, the maximum fees 
payable by persons wishing to make a complaint or to be involved as a 
party or intervenor in a hearing in respect of the assessment of property 
before an assessment review board are as follows:
	(a)	in respect of an assessment for class 1 - residential property,
	(i)	in respect of 3 dwellings or fewer,	$50;
	(ii)	in respect of more than 3 dwellings,	$650;
	(b)	in respect of an assessment for  
class 2 - non-residential property,	$650;
	(c)	in respect of an assessment for class 3 - farm land,	$50;
	(d)	in respect of an assessment for class 4 - machinery  
and equipment,	$650.
Expiry
3   For the purpose of ensuring that this Regulation is reviewed for 
ongoing relevancy and necessity, with the option that it may be 
repassed in its present or an amended form following a review, this 
Regulation expires on December 31, 2010.
Coming into force
4   This Regulation comes into force on January 1, 2009.

issued under the Livestock Identification and Commerce 
Act?";
	(b)	by striking out "held under the Livestock and Livestock 
Products Act" and substituting "held under the Livestock 
Identification and Commerce Act".

3   This Regulation comes into force on the coming into 
force of the Livestock Identification and Commerce Act.

Municipal Government Act
MATTERS RELATING TO ASSESSMENT AND TAXATION 
AMENDMENT REGULATION

1   The Matters Relating to Assessment and Taxation 
Regulation (AR 220/2004) is amended by this Regulation.

2   Section 1 is amended
	(a)	by repealing clause (i)(ii) and substituting the 
following:
	(ii)	the production of horses, cattle, bison, sheep, swine, 
goats, fur-bearing animals raised in captivity, domestic 
cervids within the meaning of the Livestock Industry 
Diversification Act, and domestic camelids, and
	(b)	in clause (j)(vi) by adding "other than a micro-generation 
generating unit as defined in the Micro-Generation 
Regulation (AR 27/2008)" after "system".

3   Section 2(a) comes into force on January 1, 2009.
