Alberta Regulation 66/2008 Securities Act SECURITIES AMENDMENT REGULATION Filed: May 7, 2008 For information only: Made by the Lieutenant Governor in Council (O.C. 192/2008) on May 7, 2008 pursuant to section 223 of the Securities Act. 1 The Securities Regulation (AR 115/95) is amended by this Regulation. 2 The Schedule is amended (a) by repealing section 1(b) and substituting the following: (b) "money market fund" means a money market fund as defined by NI 81-102; (b) in section 9(2) by striking out "$1750" and substituting "$2100"; (c) by repealing section 15; (d) in the following provisions by striking out "money market mutual fund" and substituting "money market fund": (i) section 1(d); (ii) section 4(2)(d)(i); (iii) section 5(1)(a). -------------------------------- Alberta Regulation 67/2008 Fisheries (Alberta) Act GENERAL FISHERIES (ALBERTA) (COMPETITIVE FISHING LICENCE CHANGES, 2008) AMENDMENT REGULATION Filed: May 7, 2008 For information only: Made by the Lieutenant Governor in Council (O.C. 200/2008) on May 7, 2008 pursuant to section 43 of the Fisheries (Alberta) Act. 1 The General Fisheries (Alberta) Regulation (AR 203/97) is amended by this Regulation. 2 Section 3(5)(m) is amended by adding "and the issuing to them of instruments, and the completion of acknowledgments, referred to in section 5(6)" after "participants". 3 Section 5 is amended (a) in subsection (1) by striking out "18(b)" and substituting "18(1)(b)"; (b) in subsection (1.1) by striking out "(2.1)" and substituting "(6)"; (c) by repealing subsection (2.1); (d) by adding the following after subsection (5): (6) Where the licence in question is a competitive fishing event licence, the instrument is any document issued by the licence holder that (a) indicates that the individual in question has been recorded for the purposes of section 2(1)(a.3) of the Ministerial Regulation, and (b) includes an acknowledgement, in the form required by the Director and signed by that individual, that that individual has been given a copy of and will comply with all the terms and conditions of the competitive fishing event licence that apply to the individual. 4 Section 10 is amended by adding the following after subsection (2): (3) For the purposes only of construing the definition of "sportfishing" in subsection 1(1) of the Alberta Fishery Regulations, 1998 (Canada) (SOR/98-246), the concept of fishing under the authority of "any licence issued under the provincial Act other than a Sportfishing Licence" is to be deemed to refer to lawful fishing specifically under the authority of any licence (issued under the Act) other than (a) a licence designated as a sportfishing licence in section 2(a), or (b) a sturgeon fishing licence. 5 Section 19.2 is amended by striking out "or an accurate synopsis". 6 The following is added after section 19.2: Representatives of licence holder 19.25 Notwithstanding anything in this Regulation, the holder of a competitive fishing event licence may designate any assistant referred to in section 18(2) of the Act to carry out any of its clerical duties under the Act and the regulations, including the issuing of instruments referred to in section 5(6) and the giving of notices under section 19.2. 7 The following is added after section 19.3: Exemptions 19.4(1) A competitive fishing event participant, to the extent that that individual is fishing in accordance with all the terms and conditions of the competitive fishing event licence and is otherwise lawfully engaged in fishing, is exempt (a) if applicable (and except to the extent required by those terms and conditions), from section 10(1) of the Act, and (b) from the federal sportfishing rules notwithstanding those rules. (2) In subsection (1)(b), "federal sportfishing rules" means, with reference to the Alberta Fishery Regulations, 1998 (Canada) (SOR/98-246), Part 3 and the related Schedules, and the interpretation provisions elsewhere of the terms supporting the construction of those provisions. (3) To any extent that the terms or conditions of a competitive fishing event licence are inconsistent with the terms or conditions of any other licence that a competitive fishing event participant may hold, the former prevails against the latter in a competitive fishing event. (d) Disposition of Property Regulation (AR 3/2001), section 1(2); (e) Infrastructure Grants Regulation (AR 56/2003), section 1; (f) Natural Gas Price Protection Regulation (AR 157/2001), sections 1(1)(f) and 2(3). 19 The Provincial Parks (General) Regulation (AR 102/85) is amended in section 30 by repealing subsection (5) and substituting the following: (5) If an item stored pursuant to this section is not, within 30 days of its removal or a longer period as determined by the Minister, claimed by the owner or someone on the owner's behalf in return for full payment for the removal and storage costs incurred, the item and its content, if any, shall be turned over to the Minister responsible for section 12 of Schedule 11 to the Government Organization Act to be disposed of in accordance with section 12 of Schedule 11 to the Government Organization Act as if it were unclaimed property. 20 The Dispositions and Fees Regulation (AR 54/2000) is amended in section 92 (a) in subsection (1) by striking out "Minister of Infrastructure and Transportation" and substituting "Minister of Infrastructure or Minister of Transportation, as the case may be,"; (b) by repealing subsection (2) and substituting the following: (2) Where an order under subsection (1) is in respect of the Minister of Infrastructure or Minister of Transportation, the lessee has no claim for compensation in respect of surface material removed, but the Minister of Infrastructure or Minister of Transportation, as the case may be, may pay the lessee any compensation that the Minister considers appropriate. (c) in section 5 (i) by repealing clause (h) and substituting the following: (h) to hunting on a Sunday, except (i) in WMUs 200 to 260, 300 to 360, 416 to 446, 500 to 544 and 841, or (ii) during the month of November in WMUs 400 to 412 and 414, (ii) in clause (i) by striking out "or" at the end of subclause (i.1), adding "or" at the end of subclause (ii) and adding the following after subclause (ii): (iii) under the authority of an antlerless elk special licence valid in WMU 212, from Monday to Friday of each week during the period December 1 to December 20, using a legal cross-bow, shotgun or muzzle loading firearm of .44 calibre or greater, (iii) by adding the following after clause (j): (j.1) to the hunting of white-tailed deer or mule deer other than with a bow and arrow, a cross-bow, a shotgun or a muzzle loading firearm of .44 calibre or greater in WMU 150, 151, 162, 163, 200, 234, 236, 256 or 500 during the period October 15 to October 31, (iv) in clause (m) by striking out "5 to September 25" and substituting "3 to September 27"; (v) in clause (o) by striking out "29 to December 1" and substituting "27 to November 29"; (d) in section 8(4) by adding "who holds a licence to hunt big game" after "alien" and adding "of that kind" after "a licence"; (e) in section 10(6) by striking out "September 1 to September 3" and substituting "August 30 to September 1"; (f) in section 11 by repealing clause (a); (g) in section 14 (i) in footnote 6, by adding "Wednesday," after "only on"; (ii) by adding the following after footnote 9: 10 This season does not apply to the wildlife disease control zones in WMUs 150, 151, 162 and 163. Subject to footnote 1 as it applies to mule deer seasons, the open season for mule deer and white-tailed deer in those zones with any legal weapon is from Monday to Saturday of each week from November 1 to December 20. 11 This season does not apply to the wildlife disease control zones in WMUs 236 and 256. Subject to footnote 1 as it applies to antlered mule deer seasons and to footnote 12 for anterless mule deer seasons, the open season for mule deer and white-tailed deer in those zones with any legal weapon is from November 1 to December 20. 12 In WMUs 200, 234, 236, 256 and 500, the season for anterless mule deer applies only to the holder of a resident supplemental antlerless mule deer licence. (h) by repealing Tables 1 to 4 and substituting the Tables contained in the Schedule to this Regulation. 17 Item 1 of the Schedule to the Act is amended by repealing subitem 9 and substituting the following: 9 Recorded wildlife calls or sounds or an electronically operated calling device, except where a person is hunting migratory game birds with the use of calls or sounds that mimic snow geese and the hunting does not occur with the use of decoys that mimic migratory game birds other than snow geese. (c) by adding the following after subsection (1): (2) For the purpose of the definition of cigar, reconstituted tobacco means a product that is comprised of 50% or more tobacco. 3 The following is added after section 6: 6.01(1) For the purposes of section 32(4) of the Act, the Minister may disclose to a tax collector, importer, manufacturer, wholesaler, retailer, duty free shop, marking permit holder or tear tape producer information about (a) another tax collector, importer, manufacturer, wholesaler, retailer, duty free shop, marking permit holder or tear tape producer who is licensed, registered, appointed or holds a permit under the Act, (b) a person referred to in clause (a) whose licence, registration, appointment or permit has been suspended or cancelled, (c) a consumer who is exempt under section 13(2.1), or (d) a consumer referred to in clause (c) whose identification card has been cancelled or declared to be invalid. (2) For the purposes of section 32(4) of the Act, the Minister may disclose to a duly authorized employee or agent of the Government of Alberta or an officer any information required to conduct an inspection, investigation, audit or examination under the Act or this Regulation. (3) For the purposes of section 32(5) of the Act, the Minister may publish the information described in that subsection in paper form or by electronic means. (4) For the purposes of section 32(5) of the Act, the prescribed information is (a) the type of licence, registration, permit or appointment the person holds or has been issued, (b) the effective date of the licence, registration, permit or appointment, (c) if a licence, registration, permit or appointment has been cancelled or suspended, the end date of the licence, registration, permit or appointment, (d) the person's operating name, if different from the person's legal name, and (e) the person's business contact information. (5) The information described in subsection (4) and section 32(5) of the Act may be published from the effective date of a licence, registration, permit or appointment until one year after the licence, registration, permit or appointment has been cancelled or suspended. 4 Section 9(2) is amended by adding "33," before "35". 5 Section 10 is amended (a) by adding the following after subsection (5): (5.1) For the purposes of subsection (5)(a), an applicant has not exhausted all efforts to collect the debt if the applicant continues to sell tobacco on credit to the person after the applicant has established that the debt owing by that person has become uncollectible. (b) by adding the following after subsection (6): (7) If an applicant receives a refund of tax in respect of an uncollectible debt, but manages to collect full or partial payment of the debt, the applicant shall pay back to the Minister that portion of the refund related to the amount of the debt so collected calculated in accordance with the following formula: Portion of Refund = A X C B where A is the amount of debt collected; B is the amount of uncollectible debt at the time of the application for refund; C is the amount of the refund received under this section. (8) When a refund is paid under this section, the Minister is subrogated to the rights of the applicant to recover that amount from the debtor. 6 Section 13.2(5)(b) is amended by striking out "or the Fuel Tax Act" and substituting ", the Fuel Tax Act or the Tourism Levy Act". 7 Section 13.21(1) and (2) are repealed and the following is substituted: 13.21(1) Where a ministerial identification card issued under section 13.2 has been cancelled or the Minister has declared that an identification card referred to in section 1(1)(g.1)(i) is invalid for the reason referred to in section 13.2(5)(b), the Minister may, after receiving an application in the form provided by the Minister, credit against the amount of the assessment owing, the amount of taxes paid under the Act or the Fuel Tax Act, or levies paid under the Tourism Levy Act, on any subsequent purchase of tobacco, fuel or accommodation, as the case may be. (3) The following is added after section 5.1: Exempt assets - RRSP 5.2(1) A Registered Retirement Savings Plan to the value of $5000 per adult member of the household unit is an exempt asset. (2) If a member of a household unit is a full-time learner, the household unit's Registered Retirement Savings Plans are exempt to the combined total value of $100 000. (4) Section 12 is repealed and the following is substituted: Residency 12 For the purpose of section 6(3)(a) of the Act, a member of a household unit in the full-time learner category must (a) be in Alberta, (b) be a Canadian citizen, a permanent resident of Canada or a refugee under the Immigration and Refugee Protection Act (Canada) who has been accepted to apply for permanent residency in Canada, and (c) if the member is a full-time learner, have been in Alberta at the time of acceptance in an approved training program. (5) Schedule 2 is amended by repealing section 11(4) and substituting the following: (4) Where a physician provides a written opinion that the physical health, or a psychologist or psychiatrist provides a written opinion that the mental health of a member of the household unit would be endangered by a move, and the maximum core shelter payment is inadequate, the Director may (a) provide up to $300 per month for the additional shelter cost for a period that does not exceed the greater of (i) 3 months, or (ii) in a household unit in the full-time learner category, the length of the full-time learner member's training period, and (b) renew an amount provided under clause (a)(i) for subsequent 3-month periods if the Director is satisfied that the condition continues to exist. 2(1) The Income Supports, Health and Training Benefits Amendment Regulation (AR 249/2007) is amended by this section. (2) Section 4 is repealed. (3) Section 5 is repealed. (b) by adding the following after subsection (15): (16) For the purpose of subsection (12.1), the Cold Lake Oil Sands Area is the strata and area designated as the Cold Lake Oil Sands Area by the Board pursuant to the Oil Sands Conservation Act as of September 1, 2007, and includes any pool that lies in whole or in part within that strata and area. 3 Section 21 is amended (a) by repealing subsection (3) and substituting the following: (3) If a royalty client pays a deposit to the Crown under this section during a year, the Minister shall, in each subsequent year, recalculate the deposit to be maintained by the royalty client, as an amount equal to 1/6 of the Minister's estimate of the aggregate amount of royalty compensation for which the royalty client was liable in respect of the preceding year after deducting allowable costs, multiplied by a factor determined by dividing the long term Gas Reference Price on the date on which the recalculation occurs by the average of the Gas Reference Prices for the previous year. (b) in subsection (3.1) by striking out "(3)(a)" and substituting "(3)"; (c) in subsection (4) by striking out "(3)(b)" and substituting "(3)".
