WILDLIFE (HUNTING SEASON 2005 CHANGES) 
AMENDMENT REGULATION

For information only:   Made by the Minister of Sustainable Resource Development 
(M.O. 20/2005) on June 12, 2005 pursuant to sections 12, 23 and 103(1) of the 
Wildlife Act. 


1   The Wildlife Regulation (AR 143/97) is amended by this 
Regulation.

2   Section 30(17) is amended by striking out "228, 250, 258, 
260, 310, 312, 322 to 356, 360, 436 to 446, 500 to 511, 520, 523 to 
525, 528, 534 to 537, 539, 540, 542 and 544" and substituting 
"236, 242, 250, 252, 256 to 260, 310 to 314, 322 to 356, 360, 436 to 
511, 514, 520, 521, 523 to 525, 528 and 534 to 544".

3   Section 36(4) is amended by striking out "(B)".

4   Section 50 is amended by striking out "holds a valid wildlife 
identification number card" and substituting "is eligible to obtain or 
hold a recreational licence in accordance with section 29(1)".

5   Section 120(2) is amended
	(a)	by striking out "to 410, 412 to 422, 426 to 430, 432";
	(b)	by striking out "525,".

6   Section 130 is amended
	(a)	in subsection (2) by striking out ", an elk";
	(b)	in subsection (2.1) by striking out "submit a report to 
the Service within 30 days after the date on which the wolf 
was killed" and substituting the following:
	(a)	submit a report to the Service, and 
	(b)	deliver the skull to an appointed officer,
not later than 30 days after the date on which the wolf was 
killed.
	(c)	in subsection (4) by striking out "second" and 
substituting "first".

7   Schedule 11 is amended
	(a)	in Part 4 by repealing Item 3;
	(b)	in Item 8 of Part 5 by striking out "Grande Cache Forest 
Products Haul Road" wherever it occurs and 
substituting "Foothills Forest Products Road";
	(c)	in Item 11 of Part 5 by striking out "686" wherever it 
occurs and substituting "986".

8   Schedule 15 is amended
	(a)	by repealing section 5(h) and substituting the 
following:
	(h)	to hunting on a Sunday, except in WMUs 350, 353, 354, 
357 to 360, 520 to 528, 534 to 537, 540 and 544 and in 
the Green Area portions of WMUs 326, 328, 347, 349, 
351, 352, 355, 356, 416 to 437, 440 to 446, 503, 511 to 
519, 529 to 532, 539, 542 and 841,
	(b)	in section 5(m) by striking out "8" and substituting 
"7";
	(c)	in section 5(o)
	(i)	by striking out "25" and substituting "24";
	(ii)	by striking out "27" and substituting "26";
	(d)	in section 8(2)(c) by striking out "13" and 
substituting "12";
	(e)	in section 10(6)
	(i)	by striking out "4" and substituting "3";
	(ii)	by striking out "6" and substituting "5";
	(f)	in section 11
	(i)	by adding the following after clause (a)(i.1):
	(i.2)	in WMUs 350, 353, 354, 520, 525, 528, 534, 536,

under subsection (1), it must comply with all enactments governing 
the carrying out of those functions by retailers.

3   Section 20(1) is amended by adding the following after 
clause (e):

Interpretation
1(1)  In this Regulation,


	(a)	"Act" means the Safety Codes Act;
	(b)	"Administrator" means an Administrator appointed pursuant 
to section 14(1) of the Act with respect to gas;
	(c)	"utility" means an individual, firm, corporation or other 
entity authorized to distribute gas services to a consumer in 
Alberta.
(2)  The definitions in a code declared in force in this Regulation apply 
to the words used in this Regulation.
Paramountcy
2   If there is a conflict between a code declared in force in this 
Regulation and another regulation under a statute of Alberta, the other 
regulation prevails over this Regulation.
Gas systems equipment
3(1)  No person may manufacture, install, sell or offer for sale any 
equipment related to gas systems for use in Alberta unless it has been
	(a)	tested and certified by a certification body accredited by the 
Standards Council of Canada, or
	(b)	inspected and accepted by a certification body accredited by 
the Standards Council of Canada, and the equipment bears 
evidence of having been accepted in the manner authorized 
by the certification body.
(2)  If a code, standard or body of rules declared in force under the Act, 
with respect to gas systems, refers to approved equipment, that 
equipment must meet the requirements of this section.
Natural Gas and Propane Installation Code
4(1)  In this section, "Code" means the National Standard of Canada, 
CSA-B149.1-05, Natural Gas and Propane Installation Code.
(2)  Subject to the variations set out in this section, the National 
Standard of Canada, CSA-B149.1-05, Natural Gas and Propane 
Installation Code, is the code declared in force under the Safety Codes 
Act in respect of natural gas and propane systems.
(3)  Clauses 2, 3, 4.17.2 and 9.1.3 of the Code are amended 
by striking out "National Building Code of Canada" and 
substituting "Alberta Building Code 1997".
(4)  Clause 8.12.1 is amended by striking out "local building 
code, or in the absence of such, in accordance with the National 
Building Code of Canada" and substituting "Alberta Building Code 
1997".
(5)  Clause 8.30.1 is amended by striking out "local building 
code, or in the absence of such, with the requirements of the National 
Building Code of Canada" and substituting "Alberta Building 
Code 1997".
(6)  Clause 4.8.2 of the Code is struck out and the following 
is substituted:
4.8.2   When a mobile home is placed on a permanent 
foundation, a replacement furnace or water heater is not required 
to be certified specifically for use within the mobile home but it 
shall be installed in accordance with the C.S.A. Standard Z.240.
(7)  Clause 4.8.3 of the Code is struck out and the following 
is substituted:
4.8.3   When a mobile home is placed on a permanent 
foundation and permanent structural alterations are made to the 
floor, an exterior wall, or both, gas fired appliances and gas 
supply piping may be installed in accordance with the 
requirements of the Code.
(8)  Clause 4.14.5 of the Code is struck out and the following 
is substituted:
4.14.5   An appliance shall not be installed on a roof of a 
building exceeding 13 ft (4 m) in height from grade to roof 
elevation unless direct access is provided in accordance with the 
Alberta Building Code 1997.
(9)  Clause 6.14.5 of the Code is struck out and the following 
is substituted:
6.14.5   Bending of gas supply piping shall be made only with 
bending equipment and procedures especially intended for that 
purpose.
(10)  Clause 6.15.12 of the Code is amended by adding "A 
mechanical compression transition fitting shall not be located within 
15 ft (4.5 m) of a building." after "plastic.".
(11)  The following is added after Clause 6.25.2 of the Code:
6.25.3   The fuel supply for emergency generators mentioned in 
Clauses 6.25.1 and 6.25.2 shall comply with the requirements of 
the Alberta Building Code 1997.
(12)  Clauses 7.23.2 and 7.24.2 of the Code are amended by 
striking out "local building code, or in the absence of such, in 
accordance with the National Building Code of Canada" and 
substituting "Alberta Building Code 1997".
Prohibition
5   No person shall fuse or join plastic pipe or aluminum pipe unless 
that person has satisfactorily completed a course of training prescribed 
by or acceptable to the Administrator.
Natural Gas for Vehicles Installation Code
6(1)  In this section, "Code" means the National Standard of Canada, 
CSA-B109-01, Natural Gas for Vehicles Installation Code.
(2)  Subject to the variations set out in this section, the National 
Standard of Canada, CSA-B109-01, Natural Gas for Vehicles 
Installation Code, is the code declared in force under the Safety Codes 
Act in respect of natural gas-powered vehicles.
(3)  The following is added after Clause 3.1.4 of the Code:
3.1.5   This Code and any standards referenced in the Code do 
not make or imply any assurance or guarantee with respect to the 
life expectancy, durability or operating performance of 
equipment and materials referenced in the Code.
(4)  Clause 4.4.6.1 of the Code is amended by striking out 
"Note: When the cylinder is clamped by the neck, a resilient gasket is 
not required between the clamping mount and the cylinder neck when 
direct contact between these materials does not produce galvanic 
corrosion and the clamping system does not leave a space where road 
salts and moisture may accumulate and cause corrosion that may lead 
to premature failure at either the cylinder or clamp."
(5)  Clause 4.6.8.1 of the Code is struck out and the 
following is substituted:
4.6.8.1   A pressure regulator shall be installed
	(a)	such that the regulator's weight is not placed on, or 
supported by, the attached natural gas fuel lines, and
	(b)	in an accessible location.
Propane Storage and Handling Code
7(1)  In this section, "Code" means the National Standard of Canada, 
CSA-B149.2-05, Propane Storage and Handling Code.
(2)  Subject to the variations set out in this section, the National 
Standard of Canada, CSA-B149.2-05, Propane Storage and Handling 
Code, is the code declared in force under the Safety Codes Act in 
respect of propane handling and storage.
(3)  Clauses 2 and 3 of the Code are amended by striking 
out "National Building Code of Canada" and substituting "Alberta 
Building Code 1997".
(4)  The following is added after Clause 1.5 of the Code:
1.6   This Code and any standards referenced in the Code do not 
make or imply any assurance or guarantee with respect to the life 
expectancy, durability or operating performance of equipment 
and materials referenced in the Code.
Fuel systems code
8(1)  In this section, "Code" means the National Standard of Canada, 
CSA-B149.5-05, Installation Code for Propane Fuel Systems and 
Tanks on Highway Vehicles.
(2)  Subject to the variations set out in this section, the National 
Standard of Canada, CSA-B149.5-05, Installation Code for Propane 
Fuel Systems and Tanks on Highway Vehicles, is the code declared in 
force under the Safety Codes Act in respect of the gas discipline.
(3)  Clause 5.14.1 of the Code is amended by striking out 
"Except for a vehicle with an installed tank that is equipped with a 
stop-fill valve," and substituting "Except for a vehicle that is in 
compliance with this Code,".
NGV Refuelling Stations Installation Code
9(1)  In this section, "Code" means the National Standard of Canada, 
CSA-B108-99, NGV Refuelling Stations Installation Code.
(2)  Subject to the variations set out in this section, the National 
Standard of Canada, CSA-B108-99, NGV Refuelling Stations 
Installation Code, is the code declared in force under the Safety Codes 
Act in respect of the gas discipline.
(3)  Clause 2 of the Code is amended by striking out 
"National Building Code of Canada" and substituting "Alberta 
Building Code 1997".
(4)  The following is added after Clause 3.3 of the Code:
3.4   This Code and any standards referenced in the Code do not 
make or imply any assurance or guarantee with respect to the life 
expectancy, durability or operating performance of equipment 
and materials referenced in the Code.
(5)  Clause 3.4.2 of the Code is amended by striking out 
"Clause 3.4" and substituting "Clause 3.4.1".
(6)  Clause 6.15 of the Code is amended by striking out 
"under the local building code" at the end of the Clause.
(7)  Clause 9.2 of the Code is amended by striking out 
"CAN/CGA B149.1" and substituting "CSA-B149.1-05".

Repeal
10   The Gas Code Regulation (AR 67/2001) is repealed.
Expiry
11   For the purpose of ensuring that this Regulation is reviewed for 
ongoing relevancy and necessity, with the option that it may be 
repassed in its present or an amended form following a review, this 
Regulation expires on June 30, 2011.
Coming into force
12   This Regulation comes into force on July 1, 2005.

Provincial Court Act
PROVINCIAL COURT JUDGES AND MASTERS IN CHAMBERS 
COMPENSATION AMENDMENT REGULATION

on June 21, 2005 pursuant to section 9.52 of the Provincial Court Act. 
1   The Provincial Court Judges and Masters in Chambers 
Compensation Regulation (AR 176/98) is amended by this 
Regulation.

2   Section 1 is amended by adding the following after 
subsection (3):
(4)  The annual salary to be paid to a part-time judge is 50% of the 
amount payable to a full-time judge.
(5)  If the aggregate of the part-time judge's annual salary and 
pension benefits payable during a 12-month term of appointment 
exceeds the annual salary of a full-time judge for that 12-month term 
of appointment, the annual salary payable to the part-time judge shall 
be reduced by the amount exceeded.
(6)  For the purpose of subsection (5),
	(a)	"pension benefit" means a pension benefit payable pursuant 
to regulations made under section 9.52 of the Provincial 
Court Act;
	(b)	"12-month term of appointment" means the 12-month period 
immediately following the appointment of a part-time judge 
and any subsequent 12-month period of appointment.

3   Section 1.1 is renumbered as section 1.1(1) and the 
following is added after subsection (1):
(2)  Subsection (1) ceases to apply if the judge who held the 
appointment as Chief Judge or as Assistant Chief Judge is appointed 
as a part-time judge.

4   Section 3 is repealed.

5   Section 4.1 is amended by adding the following after 
subsection (4):
(5)  Notwithstanding subsection (3)(c), a part-time judge may only 
claim a maximum allowance of $1500.

6   Schedule 1 is amended
	(a)	by repealing section 3(1) and substituting the 
following:
3(1)  Judges and masters are entitled to vacation of 30 working 
days per year and part-time judges are entitled to vacation of 
15 working days per year during the two 3-month periods they 
are required to serve.
	(b)	by repealing section 4 and substituting the 
following:
4   Judges and masters are entitled to all statutory holidays 
normally granted to employees in the Public Service of the 
Province and part-time judges are entitled to all statutory 
holidays normally granted to employees in the Public Service 
of the Province occurring during the two 3-month periods they 
are required to serve.

7   This Regulation comes into force when section 3 of the 
Provincial Court Amendment Act, 2005 comes into force.

4   Section 1 is amended
	(a)	by renumbering it as section 1(1);
	(b)	by adding the following after clause (b):
	(b.1)	"appointed", used in relation to a judge or 
supernumerary judge of the Provincial Court or a 
part-time judge, includes reappointed;
	(c)	in clause (g) by adding "part-time judge or" after "or a";
	(d)	in clause (o) by adding "(other than a former judge who 
is or was a part-time judge)" after "former judge";
	(e)	by adding the following after clause (q):
	(q.1)	"part-time judge" means a person appointed as such 
under section 9.24 of the Provincial Court Act;
	(f)	in clause (aa) by adding ", subject to subsection (1.1)," 
before "means";
	(g)	by adding the following after subsection (1):
(1.1)  To avoid doubt, where a judge is appointed as a judge 
under section 9.23 of the Act with immediate effect from the 
end of a previous term of appointment as a judge (whether 
under section 9.23 or not) and without any break, then, for the 
purposes of this Schedule, there is no termination.

5   Section 24 is amended
	(a)	in subsection (1) by adding "other than a part-time 
judge" after "A person";
	(b)	in subsection (2) by striking out "the person" and 
substituting "a person referred to in subsection (1)".

6   Section 33 is amended by adding "other than a part-time 
judge" after "A person".

7   Section 47(3) is amended by adding "or to a person 
appointed as a part-time judge" after "other than as a supernumerary 
judge".

8   Sections 68, 69, 70, 71.1 and 71.2 are repealed.

9   Schedule 2 is amended by sections 10 to 12.

10   The following is added after section 1(1):
(1.1)  Section 1(1.1) of the Registered Plan applies with respect to 
this Plan.

11   Section 1(2) is amended
	(a)	by adding ""appointed"," after ""actuary",";
	(b)	by adding ""part-time judge"," before ""pension" and".

12   Sections 68, 71.1 and 71.2 are repealed.

Administration fee - coal mine
1(1)  In this section, "coal production" means the total tons of coal 
mined in Alberta by an operator of a coal mine in the 2004 
calendar year.
(2)  The administration fees payable for the purpose of section 6 of 
the Alberta Energy and Utilities Board Act for the fiscal year 
2005-2006 by operators in respect of their coal mines are 
calculated as follows:
		coal production x $0.042231 for each ton of coal = 
administration fee.
Administration fee - power plants
2(1)  In this section, "marketed production" means the total 
electric energy generated in Alberta by each operator of a power 
plant or plants that is exchanged through the Power Pool of 
Alberta, or sold to or through the City of Medicine Hat, in the 2004 
calendar year.
(2)  The administration fees payable for the purpose of section 6 of 
the Alberta Energy and Utilities Board Act for the fiscal year 
2005-2006 by operators in respect of their power plants are 
calculated as follows:
		marketed production x $0.011362 for each MWh = 
administration fee.
(3)  Where the administration fee calculated under subsection (2) is 
less than $5000 in total, the operator is exempt from the payment 
of the administration fee.
Prescribed date
3   For the purposes of section 6 of the Alberta Energy and 
Utilities Board Act and this Regulation, the prescribed date for the 
fiscal year 2005-2006 is March 31, 2006.

	A	is the number of Class 1 oil sands projects approvals held by

between the maximum amount of bitumen volumes that may

calculated from the date of issuance to December 31 of the 
base year and rounded up to a full year (but if the bitumen 
volumes produced exceed the maximum amount that may be 
produced, A is $5000)
	B	is the variable rate selected from Table A which corresponds 
to the applicable production range from Table A that contains 
the amount that is determined by dividing the difference 
between the maximum amount of bitumen volumes that may 
be produced by the project in the base year under the

	A	is the number of Class 4 oil sands project approvals held by

(7)  An operator of one or more Class 5 approved oil sands projects 
shall pay an administration fee in respect of each project calculated 
in accordance with the following formula:

	A	is the fixed amount selected from Table B which corresponds 
to the applicable production range from Table B that contains 
the amount that is determined by dividing the difference 
between the maximum amount of bitumen volumes that may 
be produced by the project in the base year under the 
application or approval and the volumes that were actually 
produced by the age of the approval, the most recent 
amended approval or the most recent application for an 
amendment to the approval, calculated from the date of 
issuance to December 31 of the base year and rounded up to 
a full year (but if the bitumen volume produced exceed the

	B	is the variable rate selected from Table B which corresponds 
to the applicable production range from Table B that contains 
the amount that is determined by dividing the difference 
between the maximum amount of bitumen volumes that may

most recent application for an amendment to the approval, 
calculated from the date of issuance to December 31 of the

the maximum amount of bitumen volumes that may be

or approval and the volumes that were actually produced by

31 of the base year and rounded up to a full year.

3   Section 16.081 is repealed and the following is 
substituted:
16.081   For the 2005-2006 fiscal year of the Board, the annual 
adjustment factor of 0.746135 must be applied to the 
administration fees for wells described in clauses (c) to (h) of 
section 16.070.

4   Section 16.090(1) and (2) are repealed and the following 
is substituted:
16.090(1)  Any person to whom a notice pursuant to section 61 of 
the Act is given may appeal the notice, in whole or in part, to the 
Board by serving on the Board a Notice of Appeal within 30 days of 
the mailing date shown on the notice.
(2)  The Board shall hear an appeal on grounds set out in section 
62(1)(a) or (b) of the Act and may hear an appeal on any grounds the 
Board considers proper.

5   Section 16.100 is repealed and the following is 
substituted:
16.100   For the purpose of Part 10 of the Act, the prescribed date 
for the 2005-2006 fiscal year of the Board is March 31, 2006.

Municipal Government Act
INVESTMENT AMENDMENT REGULATION

1   The Investment Regulation (AR 66/2000) is amended by 
this Regulation.

2   Section 2 is amended
	(a)	in subsection (1) by repealing clause (a) and 
substituting the following:
	(a)	securities issued by a corporation incorporated or 
continued under the laws of Canada or of a province if 
the securities are rated as follows:
	(i)	if the municipality is not a municipality as defined 
in the Major Cities Investment Regulation 
(AR 249/2000), the securities must be rated by at 
least one of the rating agencies with
	(A)	a minimum R-1 or A1 or equivalent rating for 
securities with a maturity date that is less than 
one year from the securities' issue, and
	(B)	a minimum of A- or equivalent rating for 
securities with a maturity date that is one year 
or more from the securities' issue;


	(ii)	if the municipality is a municipality as defined in 
the Major Cities Investment Regulation  
(AR 249/2000), the securities must be rated by at 
least one of the rating agencies with
	(A)	a minimum R-1 or BBB- or equivalent rating 
for securities with a maturity date that is less 
than one year from the securities' issue, and
	(B)	a minimum of BBB- or equivalent rating for 
securities with a maturity date that is one year 
or more from the securities' issue,
	(b)	in subsection (2) by repealing clause (a).
3   Section 4 is amended by striking out "June 30, 2005" and 
substituting "June 30, 2010".

2   Section 2 is amended
	(a)	by adding the following after clause (d):
	(d.1)	trust capital securities,
	(b)	in clause (g) by striking out "and" after "Canada,";
	(c)	by adding the following after clause (g):
	(g.1)	income trusts that are publicly traded on a recognized 
stock exchange in or outside Canada,
	(g.2)	real estate, in the form of direct property ownership,
	(g.3)	derivatives,
	(g.4)	hedge funds, and
	(d)	in clause (h) by striking out "clauses (a) to (g)" and 
substituting "clauses (a) to (g.4)".

3   Section 3(a) is repealed.

4   Section 4 is amended
	(a)		in clause (a) by striking out "R-1 or A" and 
substituting "R-1 or BBB-";
	(b)	in clause (b) by striking out "of A-" and substituting 
"of BBB-".

5   Section 6 is amended by striking out "June 30, 2005" and 
substituting "June 30, 2010".

1   The Student Transportation Regulation (AR 250/98) is 
amended by this Regulation.

2   Section 7 is amended by striking out "August 31, 2005" 
and substituting "August 31, 2010".
