Traffic Safety Act
CARGO SECUREMENT REGULATION

Definitions
1(1)  In this Regulation,
	(a)	"Act" means the Traffic Safety Act;
	(b)	"Standard" means the National Safety Code Standard 10 
(Cargo Securement), section 1 (Interpretation) and Parts 1 to 
4, made by the Canadian Council of Motor Transport 
Administrators and dated September 23, 2004, adopted under 
section 2.
(2)  The vehicles referred to in the Standard are commercial vehicles 
for the purposes of the Act and this Regulation.
Adoption of Standard
2   The Standard is hereby adopted as amended from time to time and 
forms part of this Regulation.
Safety responsibility
3(1)  A carrier shall not permit a driver to operate a commercial 
vehicle where the cargo transported in or on the vehicle is not 
contained, immobilized or secured in accordance with the Standard as 
it relates to the particular type of commercial vehicle.
(2)  A driver shall not operate a commercial vehicle where the cargo 
transported in or on the vehicle is not contained, immobilized or 
secured in accordance with the Standard as it relates to the particular 
type of commercial vehicle.
Cargo securement
4   A driver or carrier must ensure that cargo transported by a 
commercial vehicle is contained, immobilized or secured so that it 
cannot
	(a)	leak, spill, blow off, fall from, fall through or otherwise be 
dislodged from the vehicle, or
	(b)	shift upon or within the vehicle to such an extent that the 
vehicle's stability or manoeuvrability is adversely affected.
Offence under s157 of Act
5   A person who contravenes or fails to comply with this Regulation 
is guilty of an offence.
Consequential amendments
6(1)  The Log Haul Regulation (AR 431/86) is amended
	(a)	by repealing sections 1(b) and (f), 4(a) and (b), 5, 
6(1)(a) to (c) and 6(4);
	(b)	in section 1(c) by striking out "mean logs 3 metres" 
and substituting "means logs 4.9 metres";
	(c)	in section 1(d) by striking out "3 metres" and 
substituting "4.9 metres";
	(d)	in sections 2, 3, 7(1), 9 and 10(2) by striking out 
"public" and substituting "commercial";
	(e)	in section 2 by striking out "secured and".
(2)  The Commercial Vehicle General Equipment and Safety 
Regulation (AR 435/86) is amended by repealing sections 8 
to 14.
(3)  The Consequential Amendments and Transitional 
Matters Regulation (AR 115/2003) is amended in section 1
	(a)	in clause (e) by striking out "5,";
	(b)	in clause (f) by striking out "8 to 14,".
Expiry
7   For the purpose of ensuring that this Regulation is reviewed for 
ongoing relevancy and necessity, with the option that it may be 
repassed in its present or an amended form following a review, this 
Regulation expires on November 30, 2015.
Coming into force
8   This Regulation comes into force on February 1, 2005.

CORRECTIONAL INSTITUTION AMENDMENT REGULATION

1   The Correctional Institution Regulation (AR 205/2001) is 
amended by this Regulation.

2   Section 18(c) is amended by striking out "section 68 of the 
Universities Act" and substituting "section 37(1) of the 
Post-secondary Learning Act".

Alberta Regulation 3/2005
Podiatry Act
BY-LAWS OF THE ALBERTA PODIATRY ASSOCIATION AMENDMENT

For information only:   Made by the Alberta Podiatry Association on December 10, 
2004 and approved by the Lieutenant Governor in Council (O.C. 8/2005) on January 
26, 2005 pursuant to section 4 of the Podiatry Act. 
1   The By-laws of the Alberta Podiatry Association 
(AR 195/65) are amended by this Regulation.

2   Section 2(III) is repealed and the following is substituted:
III  Fees and Fiscal Year:
	(a)	The following fees may be fixed by the Council:
	(i)	annual membership fees;
	(ii)	the fee for issuing a certificate of registration.
	(b)	The fee for an interim license or temporary membership for 
each quarter of the fiscal year is to be set at 35% of the 
annual fee set out in clause (a)(i).
	(c)	Fees are payable to the secretary-treasurer of the Association.
	(d)	The fiscal year for the Association is January 1 to December 
31.

3   Section 2(V) is repealed and the following is substituted:
V  Code of Ethics:
	(a)	Members must govern themselves in accordance with the 
Code of Conduct of the Alberta Podiatry Association as 
approved by the Association on January 20, 2001.

Alberta Regulation 4/2005
Gaming and Liquor Act
GAMING AND LIQUOR AMENDMENT REGULATION
Filed: January 27, 2005
For information only:   Made by the Lieutenant Governor in Council (O.C. 11/2005) 
on January 26, 2005 pursuant to section 129 of the Gaming and Liquor Act. 
1   The Gaming and Liquor Regulation (AR 143/96) is 
amended by this Regulation.

2   Section 47(d) is amended by striking out "manufacturer's or 
brew pub".

3   Section 55 is amended by adding the following after 
clause (b):
	(c)	cottage winery licence:  authorizes the licensee
	(i)	to manufacture wine in the licensed premises,
	(ii)	to possess and store the wine it manufactures in the 
licensed premises,
	(iii)	to sell the wine it manufactures to the Commission, and
	(iv)	to provide in accordance with board policy, wine it 
manufactures to its employees and their guests for 
consumption in the licensed premises.

4   Schedule 1 is amended in section 8 by adding the 
following after clause (b):

Alberta Heritage Scholarship Act
ALBERTA HERITAGE SCHOLARSHIP AMENDMENT REGULATION

on January 26, 2005 pursuant to section 7 of the Alberta Heritage Scholarship Act. 
1   The Alberta Heritage Scholarship Regulation (AR 214/99) 
is amended by this Regulation.

2   Section 1(a.1) and (b) are repealed and the following is 
substituted:
	(a.1)	"Alberta university" means a university as defined in the 
Post-secondary Learning Act;
	(b)	"educational institution" means
	(i)	a public post-secondary institution under the 
Post-secondary Learning Act,
	(ii)	a private college that has been designated as an 
institution that may grant a degree under the 
Post-secondary Learning Act,
	(iii)	a private vocational school under the Private Vocational 
Schools Act, or
	(iv)	a post-secondary educational institution in Alberta or 
elsewhere that is approved by the Minister for the 
purposes of this Regulation;

3   Section 3(1)(b) is amended by striking out "Learning" and 
substituting "Education".

4   Section 11 is amended by adding the following after 
subsection (4):
(5)  In this section , "educational institution" includes a non 
post-secondary education institution in Alberta or elsewhere that is 
approved by the Minister for the purposes of this section.

5   Section 19 is amended by striking out "$22 000 000" and 
substituting "$23 000 000".

CALGARY ELECTION AMENDMENT REGULATION

1   The Calgary Election Regulation (AR 31/2004) is 
amended by this Regulation.

Court of Queen's Bench Act
SURROGATE RULES AMENDMENT REGULATION

For information only:   Made by the Lieutenant Governor in Council (O.C. 55/2005) 
on January 26, 2005 pursuant to section 20 of the Court of Queen's Bench Act. 
1   The Surrogate Rules (AR 130/95) are amended by this 
Regulation.

2   Section 28(3) is amended by striking out "guarantee 
insurance as defined in that Act" and substituting "contracts of 
guarantee insurance as defined in section 1(1)(q) of the Classes of 
Insurance Regulation (AR 121/2001)".

3   Section 52 is repealed and the following is substituted:
Bonds
52(1)  An applicant under this Division must provide a bond or 
other security that is satisfactory to the court unless the court 
dispenses with this requirement under subsection (4).
(2)  The bond or other security must be in an amount equal to the 
estimated value of the property to which the order relates unless 
the court orders otherwise.
(3)  Where the court requires a bond under subsection (1), the 
bond must be from an insurer licensed under the Insurance Act to 
undertake contracts of guarantee insurance as defined in section 
1(1)(q) of the Classes of Insurance Regulation (AR 121/2001).
(4)  The court may dispense with the requirement for a bond or 
other security where the court is of the opinion that it is in the 
minor's best interests to do so.

4   Section 53 is amended by striking out "a bond" and 
substituting "the requirement for a bond or other security".

5   Schedule 3 Form NC 47 is amended
	(a)	by striking out "Affidavit to  dispense with a bond" and 
substituting "Affidavit to dispense with a bond or other 
security";
	 (b)	in section 2 by adding "or other security" after "bond";
	(c)	in section 3 by adding "or other security" after "bond".

(AR 156/2004) is amended by repealing section 3.

6   The Discipline Regulation (AR 325/82) is amended in 
section 4(3) by striking out "36" and substituting "37".

7   The Education and Training Regulation (AR 241/81) is 
amended in section 1(1)(f) by striking out "The Universities 
Act" and substituting "the Post-secondary Learning Act".

8   The Electronic Transactions Act Designation Regulation 
(AR 35/2003) is amended in the Schedule by striking out
