     ELEVATING DEVICES CODES AMENDMENT REGULATION

Made by the Lieutenant Governor in Council (O.C. 419/2002) on September 4,
2002 pursuant to section 65 of the Safety Codes Act.


1   The Elevating Devices Codes Regulation (AR 216/97) is amended by this
Regulation.


2   Section 5 is repealed.

     Reciprocal Enforcement of Maintenance Orders Act

     DECLARATION OF RECIPROCATING STATES REGULATION

Made by the Lieutenant Governor in Council (O.C. 421/2002) on September 4,
2002 pursuant to section 21 of the Reciprocal Enforcement of Maintenance
Orders Act.

     Alberta Regulation 193/2002

     Apprenticeship and Industry Training Act

     APPEAL RULES AMENDMENT REGULATION

     Filed:  September 6, 2002

Made by the Minister of Learning on September 3, 2002 pursuant to section
33(1) of the Apprenticeship and Industry Training Act.


1   The Appeal Rules Regulation (AR 58/99) is amended by this Regulation.


2   Section 19 is amended by striking out "2003" and substituting "2010".

     Alberta Regulation 194/2002

     Oil and Gas Conservation Act

     OIL AND GAS CONSERVATION AMENDMENT REGULATION

Made by the Alberta Energy and Utilities Board on September 3, 2002
pursuant to section 73 of the Oil and Gas Conservation Act.


1   The Oil and Gas Conservation Regulations (AR 151/71) are amended by
this Regulation.


2   Part 16.5 is repealed and the following is substituted:

     Part 16.5
     Orphan Fund

     16.510   In this Part,

               (a)  "facility" means facility as defined in Part 11 of
the Act;

               (b)  "unreclaimed site" mean an uncertified site within
the meaning of Interim Directive 2001-8.


     16.520   All facilities, wells and unreclaimed sites constitute one
class for the purpose of determining the orphan fund levy under this Part.


     16.530(1)  For the 2002-2003 fiscal year of the Board the orphan fund
levy payable by a licensee is calculated in accordance with the following
formula:

               Levy = A  x  $7 000 000
                                   B

          where

          A    is the licensee's deemed liability on September 7, 2002
for all facilities, wells and unreclaimed sites licensed to the licensee,
as calculated in accordance with Interim Directive 2001-8, and

          B    is the sum of the industry's liability on September 7,
2002 for all licensed facilities, wells and unreclaimed sites, as
calculated in accordance with Interim Directive 2001-8.

     (2)  A licensee shall pay the amount of the orphan fund levy not
later than the 30th day following the mailing date shown on the notice
under section 75 of the Act.

     (3)  The penalty referred to in section 74(2) of the Act is payable
on the day following the 30-day period referred to in subsection (2).


     16.540(1)  A person to whom a notice under section 75 of the Act is
given may appeal to the Board by serving a notice of appeal on the Board
not later than 30 days after the mailing date shown on the notice under
section 75 of the Act.

     (2)  In addition to the grounds for appeal set out in section
76(1)(a) and (b) of the Act, a notice under section 75 of the Act may be
appealed on any ground the Board considers proper.

     (3)  Within 30 days after the last day for receipt of a notice of
appeal, the Board shall send the appellant a notice indicating how, when
and where the appeal will be considered.

     (4)  The date for consideration of the appeal must be no sooner than
10 days after the mailing date shown on the notice referred to in
subsection (3).

Interpretation
1(1)  In this Regulation,

     (a)  "authorization holder" means a person that has been issued a
scale site authorization under section 12;

     (b)  "check scale" means a scale conducted by a forest officer or a
person authorized by the Minister to check the accuracy of another scale;

     (c)  "form TM 32" means form TM 32 prescribed by the Timber
Regulation;

     (d)  "form TM 35" means form TM 35 prescribed by the Timber
Regulation;

     (e)  "form TM 44" means form TM 44 prescribed by the Timber
Regulation;

     (f)  "mass scaling" means scaling conducted using the scaling method
set out in section 3(1)(b);

     (g)  "payment period" means payment period as defined in the Timber
Management Regulation;

     (h)  "scale" means to measure or estimate the volume of felled
timber;

     (i)  "timber operation" means timber operation as defined in the
Timber Management Regulation.

(2)  This Regulation applies to scaling conducted to provide the Minister
with an accounting of harvested timber.


Scaling
2   A person who scales timber shall do so in accordance with the
procedures established by the Minister.


Scaling methods
3(1)  A person who scales timber shall determine the volume of the timber
in cubic metres by using one of the following methods:

     (a)  by measuring the dimensions of each piece of timber and
applying

               (i)  the Alberta Cubic Metre Scale, or the formula used
to derive the Alberta Cubic Metre Scale, set out in

                         (A)  Schedule 1 if the timber is coniferous,
or

                         (B)  Schedule 2 if the timber is deciduous,

               or

               (ii) the following formula, where authorized or directed
by the Minister:

                    V = (A1 + A2) x L
                                          2
               where

               "V" is the volume of the piece of timber;
               "A1" is the area of the small end of the timber in     square metres;
               "A2" is the area of the large end of the timber in     square metres;
                "L" is the length of the timber in metres;

     (b)  by weighing the timber and applying

               (i)  a mass to volume ratio derived from scaling sample
loads of timber in accordance with section 4, or

               (ii) a fixed mass to volume ratio approved by the
Minister;

     (c)  by applying any other method established by the Minister where
authorized or directed by the Minister.

(2)  A person who scales timber using the methods set out in subsection
(1)(a) or (c) may make deductions from the gross scaled volume to account
for defects contained in that timber, in accordance with the procedures
established by the Minister.


Sample scaling
4(1)   The authorization holder for a scale site at which timber is mass
scaled shall ensure that loads of timber are selected for sample scaling in
accordance with scaling sampling plans approved by the Minister and the
scaling sampling procedures established by the Minister.

(2)  If a load of timber is selected for sample scaling under subsection
(1), the authorization holder 

     (a)  shall, within 30 days after the load of timber was selected,
ensure that a person holding a valid scaler's permit

               (i)  scales the timber using the scaling method set out
in section 3(1)(a) or (c), and

               (ii) records the information collected by that person in
accordance with section 5(1)(a) or (c),

     and

     (b)  shall ensure that a form TM 35 and a form TM 44 are completed
in accordance with section 5(1)(b).


Recording information
5(1)  A person scaling timber using the method set out in

     (a)  section 3(1)(a) shall record the information collected on form
TM 32 in accordance with the procedures established by the Minister;

     (b)  section 3(1)(b) shall record the information collected on form
TM 35 and form TM 44, in accordance with the procedures established by the
Minister;

     (c)  section 3(1)(c) shall record the information collected in a
manner and form satisfactory to the Minister.

(2)  Notwithstanding subsection (1), information that must be recorded in a
form under subsection (1) may be recorded in an electronic format approved
by the Minister.


Submitting records to Minister
6(1)  The authorization holder for a scale site shall ensure that the
records referred to in section 5 are provided to the Minister within 21
days following

     (a)  the end of each month within which timber was scaled at that
site, or

     (b)  the end of each payment period within which timber was scaled
at that site if the timber dues for that timber will be calculated in
accordance with Schedule 4 of the Timber Management Regulation.

(2)  If a scale site receives an annual volume of more than 70 000 cubic
metres of timber, as determined by the Minister, the authorization holder
for that site shall ensure that the records provided to the Minister under
subsection (1) are provided in an electronic format approved by the
Minister.


Production of records
7   A person who scales timber shall produce the person's scaling records
and notes to a forest officer on demand.


Check scaling
8(1)  The authorization holder for a scale site at which timber is mass
scaled shall ensure that the 4 most recently scaled sample loads of timber
are retained at the site and made accessible for check scaling.

(2)  Notwithstanding subsection (1), a forest officer may permit an
authorization holder to retain fewer than 4 sample loads at the scale site.

(3)  If directed to do so by a forest officer, the authorization holder for
a scale site at which timber is not mass scaled shall ensure that scaled
timber is retained as directed by the forest officer and made accessible
for check scaling.


Permit and authorization required
9(1)  No person may scale timber using the method set out in section
3(1)(a) or (c) unless

     (a)  that person holds a valid scaler's permit, and

     (b)  the timber is at a scale site for which a scale site
authorization issued under section 12 is in effect.

(2)  No person may scale timber using the method referred to in section
3(1)(b) unless

     (a)  the timber is at a scale site for which a scale site
authorization issued under section 12 is in effect, and

     (b)  the weighing equipment at that site meets the standards
established by the Minister.


Scaler's permit
10(1)  The Minister may establish classes of scaler's permits and may
specify the scope of authority that may be exercised by the holder of each
class of permit.

(2)  An application for a scaler's permit must be made in the form
specified by the Minister and be accompanied by the required fee.

(3)  The Minister may issue a scaler's permit to an applicant who has

     (a)  attained the age of 18 years,

     (b)  completed an instruction course approved by the Minister,

     (c)  completed an examination set by the Minister to a level
satisfactory to the Minister, and

     (d)  met any other requirements established by the Minister.


Term of permit
11(1)  A scaler's permit expires on the date specified on the permit.

(2)  Notwithstanding subsection (1), the Minister may cancel or suspend a
scaler's permit

     (a)  if the holder of the permit contravenes the Act or the
regulations under the Act, or

     (b)  if, in the Minister's opinion, it is in the public interest to
cancel or suspend the permit.


Scale site authorization
12(1)  The owner of a timber operation may apply in writing to the Minister
for authorization to scale timber at a site under the owner's control.

(2)  If the Minister is satisfied that a complete and accurate scale can be
performed at the site, the Minister may issue a scale site authorization to
the applicant and may attach conditions to the authorization.

(3)  The Minister may cancel or suspend a scale site authorization

     (a)  if the authorization holder contravenes the Act or the
regulations under the Act,

     (b)  if the authorization holder has failed to comply with a
condition attached to the authorization, or

     (c)  if, in the Minister's opinion, it is in the public interest to
cancel or suspend the authorization.


Repeal
13   The Scaling Regulation (AR 403/92) is repealed.


Expiry
14   For the purpose of ensuring that this Regulation is reviewed for
ongoing relevancy and necessity, with the option that it may be repassed in
its present or an amended form following a review, this Regulation expires
on June 30, 2012.
