     GENERAL FISHERIES (ALBERTA) AMENDMENT REGULATION

     Filed:  February 7, 2002

Made by the Lieutenant Governor in Council (O.C. 27/2002) on February 6,
2002 pursuant to section 43 of the Fisheries (Alberta) Act.


1   The General Fisheries (Alberta) Regulation (AR 203/97) is amended by
this Regulation.


2   Section 10(1) is amended

     (a)  in clause (e) by striking out "who engages" and substituting
"while engaging";

     (b)  by adding the following after clause (e):

               (f)  a person while engaging in sportfishing on Alberta
Family Day or on the Saturday or Sunday immediately preceding Alberta
Family Day.

     Residential Tenancies Act

     RESIDENTIAL TENANCIES EXEMPTION AMENDMENT REGULATION

Made by the Lieutenant Governor in Council (O.C. 31/2002) on February 6,
2002 pursuant to section 62 of the Residential Tenancies Act.


1   The Residential Tenancies Exemption Regulation (AR 227/92) is amended
by this Regulation.


2   The following is added after section 2:

Expiry
     3   For the purpose of ensuring that this Regulation is reviewed for
ongoing relevancy and necessity, with the option that it may be repassed in
its present or an amended form following a review, this Regulation expires
on October 31, 2004.

     Residential Tenancies Act

     RESIDENTIAL TENANCIES MINISTERIAL AMENDMENT REGULATION

     Filed:  February 7, 2002

Made by the Minister of Government Services (M.O. C:002/02) on January 28,
2002 pursuant to section 64 of the Residential Tenancies Act.


1   The Residential Tenancies Ministerial Regulation (AR 229/92) is amended
by this Regulation.


2   The following is added after section 11:

     11.1   For the purpose of ensuring that this Regulation is reviewed
for ongoing relevancy and necessity, with the option that it may be
repassed in its present or an amended form following a review, this
Regulation expires on October 31, 2004.

Made by the Lieutenant Governor in Council (O.C. 32/2002) on February 6,
2002 pursuant to section 63 of the Residential Tenancies Act.


1   The Subsidized Public Housing Regulation (AR 228/92) is amended by this
Regulation.


2   The following is added after section 4:

     4.1   For the purpose of ensuring that this Regulation is reviewed
for ongoing relevancy and necessity, with the option that it may be
repassed in its present or an amended form following a review, this
Regulation expires on October 31, 2004.

     ALBERTA RULES OF COURT AMENDMENT REGULATION

     Filed:  February 7, 2002

Made by the Lieutenant Governor in Council (O.C. 35/2002) on February 6,
2002 pursuant to section 16 of the Court of Appeal Act and section 20 of
the Court of Queen's Bench Act.


1   The Alberta Rules of Court (AR 390/68) are amended by this Regulation.


2   Rule 5(1) is amended by adding the following after clause (i):

     (i.1)     "official court reporter" means

               (i)  a person appointed as an official court reporter by
order of the Attorney General, or

               (ii) a certified shorthand reporter under the Alberta
Shorthand Reporters Regulation (AR 197/96);


3   The following is added after Rule 5.12:

Original retained by clerk
     5.13   Where a document is filed or issued under these Rules, the
clerk shall retain the original of that document.


4   Rule 15(4) is repealed.


5   Rule 130 is amended by adding the following after subrule (1):

     (1.1)  A pleading may be amended under subrule (1) to add, remove or
substitute a party.

     (1.2)  The removal of a party is subject to the payment of such costs
as the Court may order on application by the party that has been removed.


6   Rule 212(1) is amended by striking out "a court reporter" and
substituting "an official court reporter".


7   Rule 515(7) is repealed.


8   Rule 530 is amended

     (a)  by repealing subrule (1) and substituting the following:

Contents of appeal books
     530(1)  The appeal books must

                         (a)  consist of the following sections:

                                   (i)  Part I              -    Pleadings, as described in subrule (9)(a);

                                   (ii) Part II        -    Final Documents, as described in subrule (9)(b);

                                   (iii)     Part III  -    Evidence;

                                   (iv) Part IV   -    Exhibits.

                         (b)  be arranged in volumes in the following
order:

                                   (i)  First               -    Appeal Book Digest, consisting of Parts I and II;

                                   (ii) Second    -    Part III,
Evidence;

                                   (iii)     Third               -    Part IV, Exhibits.

                         (c)  contain pages numbered consecutively as
follows:

                                   (i)  Part I must commence page
numbering with page P1;

                                   (ii) Part II must commence page
numbering with page F1;

                                   (iii)     Part III must commence page
numbering with Page 1;

                                   (iv) Part IV must commence page
numbering with Page E1;

                                   (v)  if a supplementary volume
to an appeal book is filed, the page numbering for that supplementary
volume must continue sequentially from the last number of the last page of
the immediately preceding volume for the Part to which the supplementary
volume relates.

     (b)  in subrule (2)(e) by adding "of the entire appeal book" after
"contents";

     (c)  in subrule (3)(d) by striking out "Part II" and substituting
"Part III";

     (d)  by repealing subrule (5) and substituting the following:

     (5)  Notwithstanding subrules (1) and (3), when the evidence and
exhibits do not exceed a total of 25 pages, the evidence and exhibits must
be included in the Appeal Book Digest and labelled accordingly.

     (e)  in subrule (8) by adding "and" at the end of clause (d) and by
repealing clauses (f) and (g);

     (f)  by repealing subrule (9) and substituting the following:

     (9)  The hard copy Appeal Book Digest must contain the following
documents, excluding the document backers, when they are not needed to
distinguish different suits, in chronological, ascending date order:

               (a)  the pleadings, which must include

                         (i)  any amendments made at trial, and

                         (ii) any other documents by which
proceedings are commenced or by which the issues in the action are defined;

               (b)  the final documents, which must include

                         (i)  the reasons for judgment,

                         (ii) the formal judgment or order appealed
from,

                         (iii)     the Notice of Appeal,

                         (iv) the agreement as to contents of the
appeal book,

                         (v)  Form S,

                         (vi) if the appeal books have been prepared
by anyone other than Transcript Management Services of Alberta Justice,

                                   (A)  Form N, and

                                   (B)  Form O, if the appellant is
represented by counsel,

                         and

                         (vii)     in the case of a direct appeal from an
administrative tribunal, a certificate from the tribunal's records
custodian or, where the tribunal has no records custodian, an agreement as
to the authenticity of the records signed by all parties.

     (g)  by repealing subrule (10) and substituting the following:

     (10)  The electronic copy of Part III, the evidence portion of the
appeal books, must be filed with the Registrar in a format satisfactory to
the Registrar.

     (h)  by repealing subrule (11);

     (i)  by repealing subrules (15) and (16) and substituting the
following:

     (15)  Appeal books must

               (a)  be prepared promptly and filed and served forthwith
after they are prepared, and

               (b)  in any event, unless otherwise ordered by a judge,
be filed not later than 12 weeks from the date on which the agreement as to
contents was filed or fixed,

     or the appeal will be struck by the Registrar.

     (16)  Any request to prepare, or instructions to revise or
countermand, appeal books must be promptly served on Transcript Management
Services of Alberta Justice, or any other preparer, in writing, and a copy
filed with the appropriate Deputy Registrar.

     (17)  Subrule (16) does not apply to appeal books prepared wholly by
an appellant or a law office.


9   Rule 535(1) is repealed.


10   Rule 587(a) is amended by striking out "prescribed in Schedule E.1".


11   Rule 724 is amended by striking out "appointed by order of the
Attorney General".


12   Schedule A is amended

     (a)  by repealing Form N and substituting Form N in the Schedule to
this Regulation;

     (b)  by repealing Forms P and Q;

     (c)  by repealing Form R and substituting Form R in the Schedule to
this Regulation;

     (d)  by adding Form S in the Schedule to this Regulation.


13   Schedule E.1 is repealed.

     Public Trustee Act

     PUBLIC TRUSTEE COMMON FUND INTEREST RATE REGULATION

     Filed:  February 12, 2002

Made by the Public Trustee on February 7, 2002 pursuant to section 27(1) of
the Public Trustee Act.


Interest rate
1   On and after April 1, 2002 the interest payable in respect of estates,
the money of which forms the Common Fund, shall

     (a)  be at the rate of 7% per annum calculated on the minimum
monthly balance held in each estate account, and

     (b)  be credited to individual estate accounts on the last day of
each month.


Repeal
2   The Public Trustee Common Fund Interest Rate Regulation (AR 4/2001) is
repealed.


Coming into force
3   This Regulation comes into force on April 1, 2002.
