I, Kelechi Madu, Minister of Municipal Affairs, pursuant to Section 14 of the Safety Codes Act (SCA), make the following order:

 

1.    For the appointment of administrators, and to prescribe their powers and duties as set out in the attached Appendix; and

 

2.    Ministerial Order No. P:007/17 is rescinded.

Appendix to Ministerial Order No. P:002/19

Order for the Appointment of Administrators

 

1 In this Order,

 

(a) where an appointment is made on the basis of the title of a position, the positions are located within the Public Safety Division of the Ministry of Municipal Affairs, the Safety Codes Council and the Alberta Boilers Safety Association; and

 

(b) an appointment of a person by virtue of a position includes a person holding the position in an acting capacity.

 

2 The following persons are appointed with the prescribed powers and duties, subject to any terms and conditions set out below:

 

(1)        The person holding the position of Chief Fire Administrator is appointed administrator for fire protection, with the powers and duties of an administrator pursuant to:

(a)  Sections 15, 37, 38, 39, 46, 48, 49, 50, 51, 52, 56, 57, 58, 61, 62 and 63 of the Safety Codes Act, for fire protection;

(b)  Section 59 of the Safety Codes Act, for unsafe Alberta Fire Code conditions;

(c)   Section 7 of the Administrative Items Regulation (AR 16/2004); and

(d)  Sections 4 and 19 of the Permit Regulation (AR 204/2007), for fire protection and permits in the fire discipline.

                       

(2)        The person holding the position of Chief Building Administrator is appointed administrator for buildings, with the powers and duties of an administrator pursuant to:

(a)  Sections 15, 37, 38, 39, 46, 48, 49, 50, 51, 52, 56, 57, 58, 59, 61, 62 and 63 of the Safety Codes Act, for buildings;

(b)  Section 7 of the Administrative Items Regulation (AR 16/2004); and

(c)   Sections 4 and 19 of the Permit Regulation (AR 204/2007), for buildings and permits in the building discipline.

 

(3)        The person holding the position of Chief Inspector, Electrical is appointed administrator for electrical systems, with the powers and duties of an administrator pursuant to:

(a)  Sections 15, 37, 38, 39, 46, 48, 49, 50, 51, 52, 56, 57, 58, 59, 61, 62 and 63 of the Safety Codes Act, for electrical systems;

(b)  Sections 7 and 15 of the Administrative Items Regulation
(AR 16/2004);

(c)   Sections 5, 6 and 8 of the Certification and Permit Regulation  (AR 295/2009) for rural wiremen;

(d)  Section 9 of the Permit Regulation (AR 204/2007); and

(e)  Sections 4 and 19 of the Permit Regulation (AR 204/2007) for electrical systems and permits in the electrical discipline.

 

(4)        The person holding the position of Chief Inspector, Elevators is appointed administrator for elevating devices, passenger ropeways and amusement rides, with the powers and duties of an administrator pursuant to:

(a)  Sections 15, 37, 38, 39, 46, 48, 49, 50, 51, 52, 56, 57, 58, 59, 61, 62 and 63 of the Safety Codes Act, for elevating devices, passenger ropeways and amusement rides; and

(b)  Sections 7 and 16 of the Administrative Items Regulation
(AR 16/2004).

 

(5)        The person holding the position of Chief Inspector, Plumbing and Gas, is appointed administrator for plumbing and gas systems, with the powers and duties of an administrator pursuant to:

(a)  Sections 15, 37, 38, 39, 46, 48, 49, 50, 51, 52, 56, 57, 58, 59, 61, 62 and 63 of the Safety Codes Act, for plumbing and gas systems;

(b)  Section 42 of the Safety Codes Act, for certificates of competency for water and sewer service installers;

(c)   Sections 7, 12 and 13 of the Administrative Items Regulation
(AR 16/2004);

(d)  Sections 3, 6 and 8 of the Certification and Permit Regulation
(AR 295/2009) for water and sewer service installers;

(e)  the Gas Code Regulation (AR 111/2010);

(f)    Section 13 of the Permit Regulation (AR 204/2007); and

(g)  Sections 4 and 19 of the Permit Regulation (AR 204/2007) for plumbing and gas systems and permits in the plumbing and gas disciplines.

  

(6)        The person holding the position of Chief Inspector, Private Sewage and Disposal Systems, is appointed administrator for private sewage disposal systems, with the powers and duties of an administrator pursuant to:

(a)  Sections 15, 37, 38, 39, 40, 46, 48, 49, 50, 51, 52, 56, 57, 58, 59, 61, 62 and 63 of the Safety Codes Act, for private sewage disposal systems;

(b)  Section 42 of the Safety Codes Act for certificates of competency for private sewage installers;

(c)   the Private Sewage Disposal Systems Regulation (AR 229/1997);

(d)  Sections 7 and 14 of the Administrative Items Regulation
(AR 16/2004);

(e)  Sections 3, 6 and 8 of the Certification and Permit Regulation
(AR 295/2009) for private sewage installers; and

(f)    Sections 4 and 19 of the Permit Regulation (AR 204/2007) for private sewage systems and permits in the private sewage discipline.

 

(7)        The person holding the position of Manager, Data Analytics, is appointed administrator for fire reporting for the purposes of the Administrative Items Regulation (AR 16/2004), with the powers and duties of an administrator pursuant to:

(a)  Sections 48, 58, 59 and 63 of the Safety Codes Act, for fire incident reporting; and

(b)  an Administrator pursuant to Section 7 of the Administrative Items Regulation (AR 16/2004).

 

(8)        The person holding the position of Barrier-Free Administrator is appointed administrator for barrier-free design and access, with the powers and duties of an administrator pursuant to:

(a)  Sections 15, 58 and 63 of the Safety Codes Act, for barrier-free design and access; and

(b)  Section 7 of the Administrative Items Regulation (AR 16/2004).

 

(9)        The Director, Compliance and Assurance, is appointed as the administrator for administrative penalties, with the powers and duties set out in the legislation identified below:

(a)  Sections 15, 57.1, 57.2, 57.4 and 58 of the Safety Codes Act:

(b)  Section 7 of the Administrative Items Regulation (AR 16/2004); and

(c)   the Administrative Penalties Regulations (AR 207/2017).

 

(10)      The person holding the position of Administrator for certification and designation of safety codes officers, with the powers and duties of an administrator pursuant to:

(a)  Sections 31, 42, 44, 51, 52, 58 and 63 of the Safety Codes Act; and

(b)  Sections 4 and 7 of the Administrative Items Regulation (AR 16/2004).

 

(11)      The person holding the position of Administrator for the designation of accredited municipalities, accredited regional services commissions, accredited agencies and accredited corporations, with the powers and duties of an administrator pursuant to:

(a)  Sections 28, 30, 51, 52, 58 and 63 of the Safety Codes Act; and

(b)  Section 7 of the Administrative Items Regulation (AR 16/2004).

 

(12)      The person holding the position of Administrator for certificates of competency for master electricians, with the powers and duties of an administrator pursuant to:

(a)  Sections 42, 51, 52, 58 and 63 of the Safety Codes Act, for certificates of competency for master electricians;

(b)  Section 7 of the Administrative Items Regulation (AR 16/2004); and

(c)   Sections 4, 5, 6 and 8 of the Certification and Permit Regulation
(AR 295/2009) for certificates of competency for master electricians and restricted master electricians.

 

(13)      The person holding the position of Administrator for pressure equipment, with the powers and duties of an administrator pursuant to:

(a)  Sections 15, 37, 38, 39, 40, 46, 48, 49, 50, 51, 52, 56, 57, 58, 59, 61, 62 and 63 of the Safety Codes Act, for pressure equipment;

(b)  Section 42 of the Safety Codes Act for certificates of competency for pressure equipment established under the Power Engineers Regulation (AR 85/2003), Pressure Welders Regulation
(AR 169/2002) and the Pressure Equipment Safety Regulation
(AR 49/2006);

(c)   Section 7 of the Administrative Items Regulation (AR 16/2004);

(d)  the Power Engineers Regulation (AR 85/2003);

(e)  the Pressure Equipment Safety Regulation (AR 49/2006); and

(f)    the Pressure Welders Regulation (AR 169/2002).
