Water Act

(Download Version)
The Act supports and promotes the conservation and management of water, through the use and allocation of water in Alberta. It requires the establishment of a water management framework and sets out requirements for the preparation of water management plans. The Act addresses: Albertans’ rights to divert water and describes the priority of water rights among users; the types of instruments available for diversion and use of water and the associated processes for decision-making; and the range of enforcement measures available to ensure the goals of the Act are met.

Code of Practice for Outfall Structures on Water Bodies

The Code prescribes measures to be taken to protect aquatic environments during construction and other activities related to outfall structures: submission of a notice to the Director; the Code lists the information requirements of a notice; timing of activity, and nature of construction activities vary with the classification of the water body; preparation of a plan, and certification that outfall structure activity was completed according to the plan; activities be done within the manner permissible according to water body classifications described within the Code, and outside of restricted activity periods; reporting of contraventions of the Code; keeping of records and the time periods for which records must be kept.

Code of Practice for the Temporary Diversion of Water for Hydrostatic Testing of Pipelines

The Code of Practice is regulated under Section 6 of the Water (Ministerial) Regulation. Hydrostatic testing under this Code of Practice is defined as including the: a) temporary diversion of up to 30,000 cubic metres of water from any source, b) use of the water described in (a) as a test medium for pressure testing a pipeline to determine its integrity, and c) the release of the water described in (b) from any portion of the pipeline.

Code of Practice for Watercourse Crossings

The Code outlines required practices for the construction, maintenance, replacement or removal of permanent and temporary watercourse crossings, such as bridges and culverts. Water (Ministerial) Regulation

The regulation promotes the safety of dams and canals to prevent the loss of life and to prevent economic and environmental losses due to failure of these structures. This regulation is a secondary statute that provides information pertaining to the administration of the Water Act including definitions of relevant terms and activities that can be performed under the Act and the requirements. Part 6 of the regulation deals with dam and canal safety and stipulates the key requirements and administrative details for the safety of these structures.
