Community Aggregate Payment Levy Regulation

The Community Aggregate Payment Levy Regulation enables municipalities to impose a community aggregate payment levy on a shipment of sand and gravel, based on a uniform levy rate of up to a maximum of $0.25 per tonne, at the pit from which the material was extracted. Control of Corporations Regulation

This regulation establishes that a municipality or group of municipalities must receive Ministerial approval prior to establishing and controlling or acquiring control of a corporation. Subsidiaries of ENMAX Corporation and EPCOR Utilities Inc. are exempt from this requirement. It specifies what information must be included in an application, as well as establishes limits on the amount of borrowing that can be made to establish a proposed corporation. It also contains provisions to address the wind-up, amalgamation, divestiture from, and disposition of a controlled corporation.

Extension of Linear Property Regulation

The Extension of Linear Property Regulation defines electric power generation plants that have the ability to sell power as linear property for assessment and taxation purposes. Without this regulation electric power generating plants would no longer meet the definition of linear property in section 284(1)(k)(i) of the Municipal Government Act. Without this regulation these properties would meet the machinery and equipment standard for regulated property assessment and municipalities would be required to prepare the annual assessments instead of the provincial Designated Linear Assessor. This regulation works in conjunction with the Electric Energy Generation Exemption Regulation (AR205/2012). These two regulations were implemented to provide an incentive to attract new investors into the power generation market and to encourage power production for the province.

This regulation allows the Wheatland Regional Corporation to set its own utility rates independent of the Public Utilities Act and to enter into franchise agreements without Alberta Utilities Commission oversight. The regulation also provides for a dispute resolution mechanism between the corporation and a regional services commission, and limits the corporation's operations to within Alberta, unless Ministerial approval is given to operate outside of Alberta. The Wheatland Regional Corporation will provide water, wastewater management, stormwater management, and sewage disposal services to the public.
