Adverse Contractual Action Regulation

Basic automobile insurance coverage (accident benefits and third party liability) is required by law in Alberta. To ensure individuals are able to obtain basic automobile insurance coverage, Section 555 of the Insurance Act and the Adverse Contractual Action Regulation establish the ‘all comers rule,’ requiring insurers to offer basic coverage to anyone wishing to insure a private passenger vehicle in Alberta. There are very limited and specific circumstances listed in Section 555(3) of the Insurance Act where adverse contractual action may be taken, allowing insurers to refuse to provide automobile insurance or cancel an automobile insurance contract. This regulation defines additional circumstances where insurers may take adverse contractual action.
