NORTH RED DEER WATER
AUTHORIZATION ACT

Chapter N‑3.5

Preamble

WHEREAS the communities of Blackfalds, Lacombe and Ponoka and the First Nations Samson Band, Ermineskin Band, Montana Band and Louis Bull Band are experiencing problems with the quantity and quality of water from their separate existing potable water supplies;

WHEREAS water from the South Saskatchewan River Basin to these communities would provide reliable potable water to those communities;

WHEREAS the piping and discharge of treated water would result in a transfer of water to the North Saskatchewan River Basin;

WHEREAS section 47 of the Water Act requires a special Act of the Legislature to authorize the issuance of a licence to transfer water between major river basins; and

WHEREAS the Minister of Environment has complied with section 48 of the Water Act:


THEREFORE HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Alberta, enacts as follows:

North Red Deer water authorization application

1   A licence under the Water Act is authorized to be issued in respect of application number 00189571, which licence may provide for the transfer of water between the South Saskatchewan River Basin and the North Saskatchewan River Basin in an amount not to exceed 13 391 cubic decametres annually.

 

Appeals

2   No appeal lies to the Environmental Appeals Board from a decision to issue a licence authorized under section 1.
