RESTRICTED ACTIVITY AUTHORIZATION REGULATION


Definitions

1   In this Regulation,

                               (a)    repealed AR 77/2009 s2;

                              (b)    “psychosocial intervention” means the restricted activity of performing a psychosocial intervention with an expectation of treating a substantial disorder of thought, mood, perception, orientation or memory that grossly impairs

                                        (i)    judgment,

                                      (ii)    behaviour,

                                     (iii)    capacity to recognize reality, or

                                     (iv)    ability to meet the ordinary demands of life;

                           (b.1)    “regional health authority” means a regional health authority under the Regional Health Authorities Act;

                               (c)    “service provider” means a person, other than a regulated member, whose name appears on a list of service providers maintained by a regional health authority for the purposes of this Regulation and who

                                        (i)    is an employee or agent of a regional health authority and provides or supervises addictions counselling,

                                      (ii)    is not an employee or agent of a regional health authority but provides addictions counselling pursuant to a contract with a regional health authority, or

                                     (iii)    is not an employee or agent of a regional health authority but provides addictions counselling when conducting a program for the prevention or treatment of alcohol and drug abuse and receives financial assistance from a regional health authority for the program.

Authorization

2   A service provider may perform a psychosocial intervention but only for the purpose of providing addictions counselling in respect of alcohol, drugs, gambling or tobacco.

Expiry

3   For the purpose of ensuring that this Regulation is reviewed for ongoing relevancy and necessity, with the option that it may be repassed in its present or an amended form following a review, this Regulation expires on November 30, 2021.
