Commission established

1   There is hereby established a regional services commission known as the Henry Kroeger Regional Water Services Commission.

Members

2   The following municipalities shall be members of the Commission:

                               (a)    the Town of Hanna;

                              (b)    the Town of Oyen;

                               (c)    the Village of Youngstown;

                              (d)    the Village of Cereal;

                           (d.1)    The Village of Delia;

                           (d.2)    Starland County;

                               (e)    Special Areas Nos. 2, 3 and 4;

                               (f)    Municipal District of Acadia No. 34.

Services

3(1)  The Commission shall supply water services

                               (a)    to all customers who are, on the effective date of acquisition of the municipal utilities under section 5, receiving water services from the treatment facility and transmission lines constituting the system, and

                              (b)    to any additional persons to whom the board of directors of the Commission decides to supply water services.

(2)  Water services shall be supplied to all customers on an as required basis and water shortages shall be shared proportionately.

Fees for water services

4(1)  The fees to be charged by the Commission to its customers for the supplying of water services shall be based on the annual full cost recovery for supplying the services, including an allowance for the reserve accounts established under subsection (3).

(2)  Without limiting the generality of subsection (1), the cost referred to in subsection (1) includes the debt service cost of debenture repayments.

(3)  The Commission may establish and maintain 1 or more reserve accounts for the works to provide for renewals, alterations, extensions and contingencies in respect to the works and shall credit the reserve accounts and expend, use, apply and appropriate funds from them for the purposes and in the amounts it determines.

(4)  The amounts in a reserve account established under subsection (3) may be blended with other reserve accounts established by the Commission, and any interest accruing to those accounts shall be credited to each account in accordance with the interest earned on the whole.

(5)  The total amount to be placed in reserve accounts by the Commission shall be established by the board of directors on an annual basis.

(6)  Retail water rates shall be determined by each of the municipalities that are members of the Commission.

Transfer of property, etc.

5(1)  The municipalities referred to in section 2(a), (b), (c), (d) and (e) shall execute all documents and do all things necessary to transfer to the Commission all land, buildings and personal property listed in Schedule 1 to this Regulation.

(1.1)  The municipalities referred to in section 2(d.1) and (d.2) and the SDS Water Authority shall execute all documents and do all things necessary to transfer to the Commission all land, buildings and personal property listed in Schedule 2 to this Regulation.

(2)  Notwithstanding the transfer of the Hanna water treatment plant to the Commission,

                               (a)    the town of Hanna retains the right to use the Helmer supply system and pipeline, other than for purposes of domestic water supply, and

                              (b)    the Helmer supply system, including the pipeline, shall be made available to the regional utility as a source of supply on an emergency basis.

(3)  The Commission shall not sell any of the land, buildings or personal property used in connection with the supply of water services without the approval of the Lieutenant Governor in Council.

(4)  The Lieutenant Governor in Council may give his approval under subsection (3) if satisfied

                               (a)    as to the repayment of provincial grants and outstanding debt associated with that portion of the land, buildings and personal property to be sold, and

                              (b)    that the sale would not have a significant adverse effect on the supply of water services by the Commission.

Assumption of debts, etc.

6   All debts and liabilities, all titles, easements, and rights of way and crossing and all service, construction and consulting agreements incurred, held or entered into by any of the municipalities referred to in section 2 or the SDS Water Authority with respect to the applicable land, buildings and personal property listed in the Schedules to this Regulation are assumed by the Commission, and the Commission shall enter into any agreements, execute any documents and do any other things that are necessary to assume those debts, liabilities, titles, easements, rights of way and crossing and agreements.

Operating deficits

7   The Commission shall not assume operating deficits with respect to the land, buildings or personal property listed in the Schedules to this Regulation that are shown on the books of any of the municipalities that are members of the Commission or the SDS Water Authority.

Schedule 1

Assets Transferred

-  tie in to Sheerness Raw Water Supply line;

-  raw water reservoir at Sheerness;

-  pump station at Sheerness;

-  pipeline from Sheerness to Hanna;

-  Helmer Dam pump station;

-  supply line from Helmer Dam;

-  real property associated with the specified facilities;

-  all easements, crossing agreements, farm water supply agreements, grants of right‑of‑way and obligations associated with the specified facilities;

-  Hanna water treatment plant.

Schedule 2

Treated water supply pipeline from the Henry Kroeger Regional Water Commission pumping station in Hanna to the Village of Delia’s treated water storage tanks and the Hamlet of Craigmyle’s treated water supply storage tanks, including

                               (a)    9 964 metres of 150mm Series 200 pipe;

                              (b)    22 746 metres of 150mm Series 160 pipe;

                               (c)    5 123 metres of 75mm Series 160 pipe.

Related pipeline appurtenances, including 3 automatic air/vac manholes, 19 manual air release valves, 13‑150mm gate valves, 4‑75mm gate valves, pipeline warning signs and 15 089 metres of tracer wire.

Peabody Tec Tank bolted steel reservoir (32 276 USG capacity) and related appurtenances including manways, roof vents, ladder, and guard rails.

Heated underground precast concrete control vault.

One S250 X 38 I beam with CM Series 632 Model 3234 Trolley and CM Series 622 Model 2256 Hoist.

Power monitoring system including IQ central energy display, custom billing software, IQ energy sentinels, and PONI RS 232 communication adaptor.

Tank and vault located on Block 1 Registered Plan 971 0892.

2 Peerless Model 6LB 9 stage vertical open lineshaft turbine pumps with a flow capacity of 92 USGPM at 3460 RPM.

Chlorine injection equipment.
