Commission established

1   There is hereby established a regional services commission known as the Cold Lake‑Grand Centre Regional Utility Services Commission.

Change of name

1.1(1)  The name of the Commission is changed to the Cold Lake Regional Utility Services Commission.

(2)  The change of name does not affect any obligation, right, action or property of the Commission.

(3)  The use of the old name of the Commission in any proceedings, agreements, notices or documents after the name has been changed does not affect the validity of those proceedings, agreements, notices or documents.

Members

2   The following municipalities shall be members of the Commission:

                                 (a)    the City of Cold Lake;

                                 (b)    repealed AR 44/97 s4;

                                 (c)    the Cold Lake Indian Reserve No. 149;

                                 (d)    the Cold Lake Armed Forces Base;

                                 (e)    the Municipal District of Bonnyville, No. 87.

Services

3(1)  The Commission shall supply water services and sanitary sewerage services in accordance with this section.

(2)  The Commission shall supply water services

                                 (a)    to all customers who are, on the effective date of acquisition of the municipal utilities referred to in section 6 that relate to the supply of water services, receiving water services from the treatment facility and transmission lines constituting the system, and

                                 (b)    to any additional persons to whom the board of directors of the Commission decides to supply water services.

(3)  Water services shall be supplied to all customers on an as required basis and water shortages shall be shared proportionately.

(4)  The Commission

                                 (a)    shall provide for the transmission and treatment of sanitary sewage from the City of Cold Lake, and

                                 (b)    may supply the sanitary sewerage service referred to in clause (a) and any other sanitary sewerage services to any persons to whom the Board of Directors of the Commission decides to supply sanitary sewerage services.

(5)  Sanitary sewerage services shall be supplied to all customers on an as required basis.

4, 5   Repealed AR 44/97 s6.

Transfer of property, etc.

6(1)  The municipalities referred to in section 2 shall execute all documents and do all things necessary to transfer to the Commission all land, buildings and personal property listed in the Schedule to this Regulation.

(2)  The Commission shall not sell any of the land, buildings or personal property used in connection with the supply of water services or sanitary sewerage services without the approval of the Minister.

(3)  The Minister may give his approval under subsection (2) if he is satisfied

                                 (a)    as to the repayment of provincial grants and outstanding debt associated with that portion of the land, buildings and personal property to be sold, and

                                 (b)    that the sale would not have a significant adverse effect on the supply of water services or sanitary sewerage services, as the case may be, by the Commission.

Assumption of debts, etc.

7   All debts and liabilities, all titles, easements, and rights of way and crossing and all service, construction and consulting agreements incurred, held or entered into by any of the municipalities referred to in section 2 with respect to the applicable land, buildings and personal property listed in the Schedule to this Regulation are assumed by the Commission, and the Commission shall enter into any agreements, execute any documents and do any other things that are necessary to assume those debts, liabilities, titles, easements, rights of way and crossing and agreements.

Operating deficits

8   The Commission shall not assume operating deficits with respect to the land, buildings or personal property listed in the Schedule to this Regulation that are shown on the books of any of the municipalities that are members of the Commission.

Schedule   

Property, Facilities and Structures
to be Transferred to the Commission

(The following describes property, facilities and structures as they existed on July 24, 1986.)

Sewage collection and treatment facilities

1   A sewage collection and treatment facility including a sanitary sewer pipeline or lines, or other sewer lines including all fittings, valves, connections, manholes, manhole safety platforms, sewage structures, clean out and inspection chambers, and all other equipment and appurtenances incidental thereto located in, on, under or above all those easements and rights‑of‑way comprising the Cold Lake/Grand Centre Regional Sewerage System, namely

                                 (a)    as in part only, and more particularly described in the sewer pipeline - right‑of‑way plan of survey registered in the Land Titles office of the North Alberta Land Registration District in Sections 2, 3, 11, 14 and 23 TP63 RGE 2 W4M; as indicated on plans 832-2393 and 832-2096, and

                                 (b)    sewer pipeline right‑of‑way and sewage lagoon site in sections 12, 13, 24, 25, 35 and 36 TP62 RGE 2 W4M as indicated on a plan of survey registered in the Land Titles office of the North Alberta Land Registration District as plan 832-2096,

and as further and more particularly described in the construction drawings prepared for the Town of Cold Lake and the Town of Grand Centre, namely

                                 (c)    the contract drawings for the sewage lagoon, structures, access road and outfall located in the W 1/2 of section 13 TP 62 RGE 2 W4M and the NW 1/4 of section 12 TP 62 RGE 2 W4M,

                                 (d)    the contract drawings for the 800 mm forcemain from a point at 50th Avenue and 47th Street in the Town of Grand Centre to the sewage lagoon located in the W 1/2 of section 13 TP 62 RGE 2 W4M,

                                 (e)    the contract drawings for the 800 mm forcemain from the southeast lift station located at 55th Avenue and 48th Street in the Town of Grand Centre at a point located at 45th Street and the lane south of 50th Avenue in the Town of Grand Centre,

                                  (f)    the contract drawings for the south‑east lift station located in the Town of Grand Centre at approximately 55th Avenue and 48th Street,

                                 (g)    the contract drawings for the 500 mm forcemain from the south‑east lift station located at 55th Avenue and 48th Street in the Town of Grand Centre to the north‑west lift station located in the SW 1/4 of section 23 TP 63 RGE 2 W4M, and

                                 (h)    the contract drawings for the north‑west lift station located in the SW 1/4 of section 23 TP 63 RGE 2 W4M.

2   All other property, rights, real or personal, tangible or intangible owned by the Town of Cold Lake or the Town of Grand Centre to which they are entitled and are the beneficial owners and which relate to the Cold Lake/Grand Centre Sewerage System and comprise the facilities.

3   The land purchased for the sewage lagoon described as the NE 1/4 of section 21 TP 62 RGE 2 W4M and the SE 1/4 of section 28 TP 62 RGE 2 W4M.

Water treatment, transmission and pumping facilities

1   A water treatment and pumping plant, transmission mains including water pipelines, intakes, pumps, valves, meters, meter vaults, parking pads, fences, facilities, structures, inspection chambers and all other equipment and appurtenances incidental thereto, and located on

                                 (a)    firstly:  all that portion of the original road allowance adjoining the north boundary of the NW 1/2 of section 24 TP 63 RGE 2 W4M in the Province of Alberta lying west of the projection across the said road allowance of the eastern limit of Beebo Avenue as shown on Plan 515 E.O. and lying east of the shore of Cold Lake as shown on a plan of survey of the said township signed at Ottawa on the 12th day of August A.D. 1924, containing eighteen hundredths (0.18) of an acre more or less excepting thereout all mines and minerals, and

                                 (b)    secondly:  all that portion of the NW 1/4 LSD 13-24‑G3-2‑W4 which lies north‑west of the south‑east limit course W.P.P. 2 - W.P.P.6‑A as shown on Road Plan 93 B.M. containing thirty‑three hundredths (0.33) of an acre more or less excepting thereout all mines and minerals,

and as further and more particularly described in the construction drawings prepared for the Town of Cold Lake, the Town of Grand Centre, the Department of National Defence, the Cold Lake Indian Band as represented by the Department of Indian Affairs, as the case may be, all of which details the following facilities:

                                 (c)    the twin 300 mm diameter pipelines from the water treatment plant to the meter vault at CFB Medley,

                                 (d)    the meter vault and inline booster station at CFB Medley,

                                 (e)    the 150 mm diameter branch line from the inline booster station to the Cold Lake First Nations Indian Reserve, I.R. 149, and

                                  (f)    the 250 mm diameter and the 150 mm diameter pipelines from the meter vault at CFB Medley to the water reservoir in the Town of Grand Centre.

2   All other property, rights, real or personal, tangible or intangible owned by the Town of Cold Lake, the Town of Grand Centre, the Department of National Defence, the Cold Lake Indian Band or the Department of Indian Affairs to which they are entitled and are the beneficial owners and which relate to the Cold Lake/Grand Centre water system and comprise the facilities.
